كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ Who ruled in favor of preemption for a neighbor.
مَنْ كَانَ يَقْضِي بِالشُّفْعَةِ لِلْجَارِ
Musannaf Ibn Abi Shaybah 22726
Hazrat Ibrahim said that the one who has more right (to inherit) is the one who shares in the inheritance, and if there is no one who shares in the inheritance, then the neighbor has more right.
حضرت ابراہیم فرماتے ہیں کہ شریک شفعہ کا زیادہ حق دار ہے، اور اگر کوئی شریک نہ ہو تو پھر پڑوسی زیادہ حق دار ہے۔
Hazrat Ibrahim farmate hain ke sharik shafa ka zyada haqdaar hai, aur agar koi sharik na ho to phir padosi zyada haqdaar hai.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا شَرِيكٌ ، عَنْ مُغِيرَةَ ، عَنْ إِبْرَاهِيمَ ، قَالَ : « الشَّرِيكُ أَحَقُّ بِالشُّفْعَةِ ، فَإِنْ لَمْ يَكُنْ لَهُ شَرِيكٌ فَالْجَارُ »
