كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ Who said: 'If there is a road between two properties, there is no preemption.'
مَنْ قَالَ: إِذَا كَانَ بَيْنَ الدَّارَيْنِ طَرِيقٌ فَلَا شُفْعَةَ فِيهِ

It was asked from Hazrat Hukm and Hazrat Hammad about the right of Shuffah. They said: If there is no path between the two houses then the right of Shuffah is established.
حضرت حکم اور حضرت حماد سے شفعہ کے متعلق دریافت کیا گیا ؟ فرمایا : اگر دو گھروں کے درمیان راستہ نہ ہو تو ان میں حق شفعہ حاصل ہے۔
Hazrat Hukam aur Hazrat Hammad se shafa ke mutalliq daryaft kya gaya? Farmaya: Agar do gharon ke darmiyan rasta na ho to un mein haq shafa hasil hai.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا غُنْدَرٌ ، عَنْ شُعْبَةَ ، قَالَ : سَأَلْتُ الْحَكَمَ ، وَحَمَّادًا ، عَنِ الشُّفْعَةِ ، فَقَالَ : « إِذَا كَانَتِ الدَّارُ إِلَى جَنْبِ الدَّارِ لَيْسَ بَيْنَهُمَا طَرِيقٌ ، فَفِيهَا شُفْعَةٌ »
