كِتَابُ الْبُيُوعِ وَالْأَقْضِيَةِ
Regarding a man who pawns with another, and the pawn is lost.
فِي الرَّجُلِ يُرْهِنُ الرَّجُلَ فَيَهْلَكُ

Musannaf Ibn Abi Shaybah 22800
It is narrated on the authority of Mu'awiyah ibn Abi Sufyan that a person mortgaged a house for a fixed period of time. When the time was up, the mortgagee said, "This is my house." The Prophet (peace and blessings of Allah be upon him) said, "The mortgaged property cannot be withheld after the term."
حضرت معاویہ بن عبداللہ بن جعفر سے مروی ہے کہ ایک شخص نے ایک مدت مقررہ کے لیے گھر رہن رکھوایا، جب وقت پورا ہوگیا تو مرتہن نے کہا یہ میرا گھر ہے۔ حضور اقدس (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : رہن کو روک کر نہیں رکھا جاسکتا۔
Hazrat Muawiya bin Abdullah bin Jaffar se marvi hai keh aik shakhs ne aik muddat muqarrah ke liye ghar raihan rakhwaya, jab waqt poora hogaya to murtahin ne kaha yeh mera ghar hai. Huzoor Aqdas (Sallallahu Alaihi Wasallam) ne irshad farmaya : raihan ko rok kar nahi rakha jasakta.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا وَكِيعٌ ، قَالَ : حَدَّثَنَا إِسْرَائِيلُ ، عَنِ ابْرَاهِيمَ بْنِ عَامِرِ بْنِ مَسْعُودٍ الْجُمَحِيِّ ، عَنْ مُعَاوِيَةَ بْنِ عَبْدِ اللَّهِ بْنِ جَعْفَرٍ أَنَّ رَجُلًا رَهَنَ دَارًا إِلَى أَجَلٍ ، فَلَمَّا حَلَّ الرَّهْنُ ، قَالَ الْمُرْتَهِنُ : دَارِي ، فَقَالَ رَسُولُ اللَّهِ ﷺ : « لَا يَغْلَقُ الرَّهْنُ »
