Regarding a woman who marries her own slave.

Musannaf Ibn Abi Shaybah 28760
Hazrat Haseen narrated that Hazrat Bakr reported: A woman married her slave, so she was questioned about it. She said: Did Allah, the Exalted, not say: 'And those whom your right hands possess.' So my right hand possessed him. And another woman married without witnesses and the permission of her guardian, so she was questioned about it. She said: I am a mature woman and I have control over my affairs. So the matter of both of them was presented before Hazrat Umar. You gathered the people and asked them about both of them. The people said: Indeed, both of them argued with the Book of Allah, the Exalted. And Hazrat Ali also said: Indeed, both of them argued with the Book of Allah, the Exalted. So you lashed each of them with a hundred lashes. Then you wrote to the governors of the cities: Whoever marries her slave or whoever marries without the permission of her guardian, then she will be in the category of adulteress.
حضرت حصین فرماتے ہیں کہ حضرت بکر نے ارشاد فرمایا : ایک عورت نے اپنے غلام سے شادی کی پس اس سے اس بارے میں پوچھا گیا ؟ تو وہ کہنے لگی : کیا اللہ رب العزت نے یوں نہیں فرمایا : اور وہ جن کے تمہارے داہنے ہاتھ مالک ہیں، تو میرا داہنا ہاتھ اس کا مالک ہے، اور ایک دوسری عورت نے بغیر گواہی اور ولی کی اجازت کے بغیر شادی کی پس اس سے اس بارے میں پوچھا گیا ؟ تو وہ کہنے لگی : میں ثیبہ عورت ہوں اور مجھے میرے معاملہ کا اختیار ہے سو ان دونوں کا معاملہ حضرت عمر کی خدمت میں پیش کیا گیا۔ آپ نے لوگوں کو جمع کر کے ان سے ان دونوں کے بارے میں پوچھا ؟ لوگوں نے کہا ! تحقیق ان دونوں نے اللہ جل جلالہ کی کتاب سے جھگڑا کیا ہے اور حضرت علی نے بھی فرمایا : تحقیق ان دونوں نے اللہ جل جلالہ کی کتاب سے جھگڑا کیا ہے۔ سو آپ نے ان دنوں میں سے ہر ایک کو سو سو کوڑے مارے پھر آپ نے شہروں کے امراؤں کو خط لکھ دیا : جو کوئی عورت اپنے غلام سے شادی کرلے یا وہ ولی کی اجازت کے بغیر شادی کرلے تو زانیہ کے درجہ میں ہوگی۔
Hazrat Haseen farmate hain keh Hazrat Bakr ne irshad farmaya: Aik aurat ne apne ghulam se shadi ki pas us se is bare mein poocha gaya? To woh kehne lagi: Kia Allah Rab ul Izzat ne yun nahi farmaya: Aur woh jin ke tumhare dahine hath malik hain, to mera dahina hath iska malik hai, aur ek dusri aurat ne baghair gawahi aur wali ki ijazat ke baghair shadi ki pas us se is bare mein poocha gaya? To woh kehne lagi: Mein saibah aurat hun aur mujhe mere mamle ka ikhtiyar hai so in donon ka mamla Hazrat Umar ki khidmat mein pesh kia gaya. Aap ne logon ko jama kar ke un se in donon ke bare mein poocha? Logon ne kaha! Tahqiq in donon ne Allah Jalla Jalaluhu ki kitaab se jhagda kia hai aur Hazrat Ali ne bhi farmaya: Tahqiq in donon ne Allah Jalla Jalaluhu ki kitaab se jhagda kia hai. So aap ne in donon mein se har ek ko sau sau korey marey phir aap ne shehron ke umaraon ko khat likh dia: Jo koi aurat apne ghulam se shadi kar le ya woh wali ki ijazat ke baghair shadi kar le to zaniyah ke darja mein hogi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا مُحَمَّدُ بْنُ فُضَيْلٍ ، عَنْ حُصَيْنٍ ، عَنْ بَكْرٍ ، قَالَ : تَزَوَّجَتِ امْرَأَةٌ عَبْدَهَا ، فَقِيلَ لَهَا ، فَقَالَتْ : أَلَيْسَ اللَّهُ يَقُولُ : ﴿ أَوْ مَا مَلَكَتْ أَيْمَانُكُمْ ﴾ [ النساء : ٣ ] فَهَذَا يَمْلِكُ يَمِينِي ، وَتَزَوَّجَتِ امْرَأَةٌ مِنْ غَيْرِ بَيِّنَةٍ وَلَا وَلِيٍّ ، فَقِيلَ لَهَا فَقَالَتْ : أَنَا ثَيِّبٌ وَقَدْ مَلَكْتُ أَمْرِي ، فَرُفِعَتْ إِلَى عُمَرَ ، فَجَمَعَ النَّاسَ فَسَأَلَهُمْ ، فَقَالُوا : قَدْ خَاصَمْنَاكَ بِكِتَابِ اللَّهِ ﷻ ، وَقَالَ عَلِيٌّ : قَدْ خَاصَمْتُكَ بِكِتَابِ اللَّهِ ، فَجَلَدَ كُلَّ وَاحِدٍ مِنْهُمَا مِائَةَ جَلْدَةٍ ، ثُمَّ كَتَبَ إِلَى الْأَمْصَارِ : « أَيُّمَا امْرَأَةٍ تَزَوَّجَتْ عَبْدَهَا أَوْ تَزَوَّجَتْ بِغَيْرِ وَلِيٍّ فَهِيَ بِمَنْزِلَةِ الزَّانِيَةِ »
