Book of Judgments of the Messenger of Allah ﷺ
٢٧-
كِتَابُ أَقْضِيَةِ رَسُولِ اللَّهِ ﷺ
Regarding a drunk person who kills.
فِي السَّكْرَانِ يَقْتُلُ

Hazrat Ali said that if a person sells a slave and the slave has some wealth, then that wealth will go to the seller unless the buyer makes it a condition. Prophet Muhammad (peace and blessings of Allah be upon him) also gave the same verdict.
حضرت علی فرماتے ہیں کہ جس شخص نے کوئی غلام فروخت کیا اور اس غلام کے پاس کچھ مال تھا تو وہ مال فروخت کرنے والے کو ملے گا مگر یہ کہ خریدنے والا شرط لگا دے۔ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے ایسے ہی فیصلہ فرمایا تھا۔
Hazrat Ali farmate hain keh jis shakhs ne koi ghulam farokht kya aur us ghulam ke pass kuch maal tha to woh maal farokht karne wale ko mile ga magar yeh keh kharidne wala shart laga de. Rasool Allah (Sallallahu Alaihi Wasallam) ne aise hi faisla farmaya tha.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ ، عَنْ جَعْفَرٍ ، عَنْ أَبِيهِ ، قَالَ : قَالَ عَلِيٌّ : « مَنْ بَاعَ عَبْدًا ، وَلَهُ مَالٌ ، فَمَالُهُ لِلْبَائِعِ ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ ، قَضَى بِهِ رَسُولُ اللَّهِ ﷺ »
