Regarding a drunk person who kills.

Musannaf Ibn Abi Shaybah 29083
Hazrat Abdullah bin Ubaid bin Umair narrates that a brother from Banu Zuraiq wrote me a letter and asked, "In whose favor did the Messenger of Allah (peace and blessings of Allah be upon him) rule in the case of the child of a woman who performed Li'an?" So I wrote to him in response that the Messenger of Allah (peace and blessings of Allah be upon him) ruled in favor of the mother regarding that child, that she is for that child in the place of the father as well as in the place of the mother.
حضرت عبداللہ بن عبید بن عمیر فرماتے ہیں کہ بنو زریق کے ایک بھائی نے مجھے خط لکھ کر پوچھا ؟ کہ لعان کرنے والی کے بچہ کا فیصلہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے کس کے حق میں فرمایا تھا ؟ تو میں نے جواب میں اس کی طرف لکھا کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے ماں کے حق میں اس بچہ کا فیصلہ فرمایا تھا کہ وہ اس بچہ کے لیے باپ کے درجہ میں بھی ہے اور ماں کے درجہ میں بھی۔
Hazrat Abdullah bin Ubaid bin Umair farmate hain ki Banu Zuraiq ke aik bhai ne mujhe khat likh kar poocha? Ki laan karne wali ke bachche ka faisla Rasool Allah (Sallallahu Alaihi Wasallam) ne kis ke haq mein farmaya tha? To maine jawab mein uski taraf likha ki Rasool Allah (Sallallahu Alaihi Wasallam) ne maan ke haq mein us bachche ka faisla farmaya tha ki woh us bachche ke liye baap ke darje mein bhi hai aur maan ke darje mein bhi.
حَدَّثَنَا أَبُو بَكْرٍ قَالَ : حَدَّثَنَا وَكِيعٌ ، عَنْ سُفْيَانَ ، عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُبَيْدِ بْنِ عُمَيْرٍ ، قَالَ : كَتَبَ إِلَيَّ أَخٌ مِنْ بَنِي زُرَيْقٍ : لِمَنْ قَضَى رَسُولُ اللَّهِ ﷺ بِابْنِ الْمُلَاعَنَةِ ؟، فَكَتَبْتُ إِلَيْهِ : « أَنَّ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ لِأُمِّهِ ، هِيَ بِمَنْزِلَةِ أَبِيهِ وَبِمَنْزِلَةِ أُمِّهِ »
