٣٣-
كِتَابُ الْفَرَائِضِ Who said: If the agnates, one of them is closer by the mother, then he gets the wealth
مَنْ قَالَ: إِذَا كَانَتِ الْعَصَبَةُ أَحَدُهُمْ أَقْرَبَ بِأُمٍّ فَلَهُ الْمَالُ

Musannaf Ibn Abi Shaybah 31558
Ibrahim narrates that Hazrat Umar said that when there is someone in the tribe who is closer to the mother then the inheritance is for him.
ابراہیم فرماتے ہیں کہ حضرت عمر نے فرمایا کہ جب عصبہ میں کوئی ماں کے زیادہ قریب ہو تو ولاء میں مال اسی کے لیے ہے۔
Ibrahim farmate hain keh Hazrat Umar ne farmaya keh jab asaba mein koi maan ke zyada qareeb ho to wilayat mein maal usi ke liye hai.
حَدَّثَنَا جَرِيرٌ ، عَنْ مَنْصُورٍ ، عَنْ إِبْرَاهِيمَ ، قَالَ : قَالَ عُمَرُ : إِذَا كَانَتِ الْعَصَبَةُ أَحَدُهُمْ أَقْرَبَ بِأُمٍّ ، قَالَ : « فَالْوَلَاءُ لَهُ »
