Musannaf Ibn Abi Shaybah: Book of Inheritance

A man died and left two sisters from his father and mother, and brothers and sisters from his father, or he left a daughter, granddaughters, and a grandson.

‌رَجُلٌ مَاتَ وَتَرَكَ أُخْتَيْهِ لِأَبِيهِ وَأُمِّهِ وَإِخْوَةً وَأَخَوَاتٍ لِأَبٍ أَوْ تَرَكَ ابْنَتَهُ وَبَنَاتِ ابْنَةٍ وَابْنَ ابْنَةٍ

Regarding a man who left two daughters, a granddaughter, and a grandson lower than her.

‌فِي رَجُلٍ تَرَكَ ابْنَتَيْهِ وَابْنَةَ ابْنِهِ وَابْنَ ابْنٍ أَسْفَلَ مِنْهَا

Regarding a daughter, a granddaughter, grandsons, sons of a sister from the father and mother, and brothers and sisters from the father.

‌فِي ابْنَةٍ وَابْنَةِ ابْنٍ وَبَنِي ابْنٍ وَبَنِي أُخْتٍ لِأَبٍ وَأُمٍّ وَأَخٍ وَأَخَوَاتٍ لِأَبٍ

Regarding the sons of a paternal uncle, one of whom is a maternal brother.

‌فِي بَنِي عَمٍّ أَحَدُهُمْ أَخٌ لِأُمٍّ

Regarding the sons of a paternal uncle, one of whom is the husband.

‌فِي بَنِي عَمٍّ أَحَدُهُمُ الزَّوْجُ

Regarding two maternal brothers, one of whom is a paternal cousin.

‌فِي أَخَوَيْنِ لِأُمٍّ أَحَدُهُمَا ابْنُ عَمٍّ

Regarding a daughter and two paternal cousins, one of whom is a maternal brother.

‌فِي ابْنَةٍ وَابْنَيْ عَمٍّ أَحَدُهُمَا أَخٌ لِأُمٍّ

Regarding a woman who left her uncles, one of whom is her maternal brother.

‌فِي امْرَأَةٍ تَرَكَتْ أَعْمَامَهَا أَحَدُهُمْ أَخُوهَا لِأُمِّهَا

Regarding a woman who left her maternal brothers, men and women, and they are her paternal cousins in inheritance.

‌فِي امْرَأَةٍ تَرَكَتْ إِخْوَتَهَا لِأُمِّهَا رِجَالًا وَنِسَاءً وَهُمْ بَنُو عَمِّهَا فِي الْعَصَبَةِ

Regarding two daughters and grandsons, men and women.

‌فِي ابْنَتَيْنِ وَبَنِي ابْنٍ رِجَالٍ وَنِسَاءٍ

Regarding a husband, mother, brothers, and sisters from the father and mother, and maternal brothers, who combined between them?

‌فِي زَوْجٍ وَأُمٍّ وَإِخْوَةٍ وَأَخَوَاتٍ لِأَبٍ وأُمٍّ وَإِخْوَةٍ لِأُمٍّ، مَنْ شَرَّكَ بَيْنَهُمْ

Whoever did not combine the brothers and sisters from the father and mother with the maternal brothers in their third and said: it is for them.

‌مَنْ كَانَ لَا يُشْرِكُ بَيْنَ الْإِخْوَةِ وَالْأَخَوَاتِ لِأَبٍ وَأُمٍّ مَعَ الْإِخْوَةِ لِلْأُمِّ فِي ثُلُثِهِمْ وَيَقُولُ: هُوَ لَهُمْ

Regarding the maternal aunt and paternal aunt, who made them inheritors?

‌فِي الْخَالَةِ وَالْعَمَّةِ مَنْ كَانَ يُوَرِّثُهُمَا

A man died and left only a maternal uncle.

‌رَجُلٌ مَاتَ، وَلَمْ يَتْرُكْ إِلَّا خَالًا

A man died and left his maternal uncle and niece or his niece.

‌رَجُلٌ مَاتَ وَتَرَكَ خَالَهُ وَابْنَةَ أَخِيهِ أَوِ ابْنَةَ أَخِيهِ

Regarding a daughter and his freed slave.

‌فِي ابْنَةٍ وَمَوْلَاهُ

Regarding the slave and the people of the book, who said: they neither prevent nor inherit.

‌فِي الْمَمْلُوكِ وَأَهْلِ الْكِتَابِ مَنْ قَالَ: لَا يَحْجُبُونَ وَلَا يُوَرَّثُونَ

Who prevented by them but did not make them inherit.

‌مَنْ كَانَ يَحْجُبُ بِهِمْ وَلَا يُوَرِّثُهُمْ

‌فِي ابْنَةِ أَخٍ وَعَمَّةٍ ، لِمَنِ الْمَالُ

‌مَنْ قَالَ يُضْرَبُ بِسَهْمِ مَنْ لَا يَرِثُ

Regarding a Muslim woman who died and left her husband, her Muslim maternal brothers, and a Christian son.

‌فِي امْرَأَةٍ مُسْلِمَةٍ مَاتَتْ، وَتَرَكَتْ زَوْجَهَا وَإِخْوَةً لِأُمٍّ مُسْلِمِينَ وَابْنًا نَصْرَانِيًّا

Regarding a Muslim woman who left her Muslim mother and has Christian, Jewish, or non-believing brothers.

‌فِي امْرَأَةٍ مُسْلِمَةٍ تَرَكَتْ أُمَّهَا مُسْلِمَةً وَلَهَا إِخْوَةٌ نَصَارَى أَوْ يَهُودٌ أَوْ كُفَّارٌ

Regarding a woman who left her husband and free maternal brothers, and she has a slave son.

‌فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَإِخْوَتَهَا لِأُمِّهَا أَحْرَارًا وَلَهَا ابْنٌ مَمْلُوكٌ

Regarding the inheritance shares, who said they do not increase and who made them increase.

‌فِي الْفَرَائِضِ مَنْ قَالَ: لَا تَعُولُ وَمَنْ أَعَالَهَا

‌فِي الْمَرْأَةِ تَرَكَتِ ابْنَتَهَا وَابْنَةَ ابْنِهَا وَأُمَّهَا، وَلَا عَصَبَةَ لَهَا

‌فِيمَنْ يَرِثُ مِنَ النِّسَاءِ كَمْ هُنَّ

‌فِي رَجُلٍ تَرَكَ أَخَاهُ لِأَبِيهِ وَأُمِّهِ أَوْ أُخْتَهُ وَجَدَّهُ

Regarding a man who left his grandfather and his paternal brother and sister.

‌فِي رَجُلٍ تَرَكَ جَدَّهُ وَابْنَ أَخِيهِ لِأَبِيهِ وَأُمِّهِ

Regarding a man who left his grandfather, paternal brother, and maternal brother.

‌فِي رَجُلٍ تَرَكَ جَدَّهُ وَأَخَاهُ لِأَبِيهِ وَأُمِّهِ وَأَخَاهُ لِأَبِيهِ

‌فِي رَجُلٍ تَرَكَ جَدَّهُ وَأَخَاهُ لِأُمِّهِ

Regarding a husband, mother, brothers, and a grandfather, this is called the Akdariyya case.

‌فِي زَوْجٍ وَأَمٍّ وَإِخْوَةٍ وَجَدٍّ فَهَذِهِ الَّتِي تُسَمَّى الْأَكْدَرِيَّةُ

‌مَمْلُوكٌ تَزَوَّجَ حُرَّةً، ثُمَّ إِنَّهُ أُعْتِقَ بَعْدَمَا وَلَدَتْ لَهُ أَوْلَادًا، لِمَنْ يَكُونُ وَلَاءُ وَلَدِهِ

Who said: If I was born while he was a slave, his loyalty goes to my mother's masters

‌مَنْ كَانَ يَقُولُ: مَا وُلِدْتُ وَهُوَ مَمْلُوكٌ، فَوَلَاؤُهُ لِمَوَالِي أُمِّهِ

‌فِي رَجُلٍ أَعْتَقَهُ قَوْمٌ، وَأَعْتَقَ أَبَاهُ آخَرُونَ
