Hazrat Ibrahim states regarding a woman who leaves her husband, mother, father, brother, and paternal grandfather, that according to the decree of Hazrat Ali and Zaid (may Allah be pleased with them), half of the wealth will be given to the husband, which is three shares, one-third of the wealth to the mother, which is two shares, and one share to the paternal grandfather. And in the decree of Hazrat Abdullah (may Allah be pleased with him), half of the wealth is for the husband, one-third of the remaining wealth for the mother, one share for the paternal grandfather, and one share for the brother. And if there are two or more brothers, then half of the wealth is for the husband, one share each for the mother and paternal grandfather, and the remaining one share will be distributed among the brothers. This is the statement of Hazrat Ali, Zaid, and Abdullah (may Allah be pleased with them).
حضرت ابراہیم اس عورت کے بارے میں فرماتے ہیں جو اپنے شوہر، ماں، باپ شریک بھائی اور دادا کو چھوڑ جائے کہ حضرت علی اور زید (رض) کے فرمان کے مطابق شوہر کو آدھا مال یعنی تین حصّے، ماں کو ایک تہائی مال یعنی دو حصّے اور دادا کو ایک حصّہ دیا جائے گا، اور حضرت عبداللہ (رض) کے فرمان میں شوہر کے لیے آدھا مال ، ماں کے لیے بقیہ مال کا ایک تہائی ، دادا کے لیے ایک حصّہ اور ایک حصّہ بھائی کے لیے ہے، اور اگر بھائی دو یا دو سے زیادہ ہوں تو شوہر کے لیے آدھا مال اور ماں اور دادا کے لیے ایک ایک حصّہ ہے، اور ایک حصّہ جو باقی بچے گا بھائیوں میں تقسیم کردیا جائے گا، یہ حضرت علی، زید اور عبداللہ (رض) کا قول ہے۔
Hazrat Ibrahim us aurat ke bare mein farmate hain jo apne shohar, maan, baap, sharik bhai aur dada ko chhod jaye ke Hazrat Ali aur Zaid (Razi Allahu Anhuma) ke farman ke mutabiq shohar ko aadha maal yani teen hisse, maan ko ek tihai maal yani do hisse aur dada ko ek hissa diya jayega, aur Hazrat Abdullah (Razi Allahu Anhu) ke farman mein shohar ke liye aadha maal, maan ke liye baqi maal ka ek tihai, dada ke liye ek hissa aur ek hissa bhai ke liye hai, aur agar bhai do ya do se ziada hon to shohar ke liye aadha maal aur maan aur dada ke liye ek ek hissa hai, aur ek hissa jo baqi bachega bhaiyon mein taqseem kar diya jayega, yeh Hazrat Ali, Zaid aur Abdullah (Razi Allahu Anhum) ka qaul hai.
حَدَّثَنَا ابْنُ فُضَيْلٍ ، عَنْ بَسَّامٍ ، عَنْ فُضَيْلٍ ، قَالَ : قَالَ إِبْرَاهِيمُ : فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَأُمَّهَا وَأَخَاهَا لِأَبِيهَا وَجَدِّهَا ، « لِلزَّوْجِ النِّصْفُ ثَلَاثَةُ أَسْهُمٍ ، وَلِلْأُمِّ الثُّلُثُ سَهْمَانِ ، وَلِلْجَدِّ سَهْمٌ » فِي قَوْلِ عَلِيٍّ وزَيْدٍ : وَفِي قَوْلِ عَبْدِ اللَّهِ : « لِلزَّوْجِ النِّصْفُ ، وَلِلْأُمِّ ثُلُثُ مَا بَقِيَ سَهْمٌ ، وَلِلْجَدِّ سَهْمٌ وَلِلْأَخِ سَهْمٌ ، فَإِنْ كَانَا أَخَوَيْنِ أَوْ أَكْثَرَ مِنْ ذَلِكَ ، فَلِلزَّوْجِ النِّصْفُ ، وَلِلْأُمِّ سَهْمٌ وَلِلْجَدِّ سَهْمٌ ، وَبَقِيَ سَهْمٌ فَهُوَ لِإِخْوَتِهِ » فِي قَوْلِ عَلِيٍّ وَزَيْدٍ وَعَبْدِ اللَّهِ
