Regarding a husband and two parents, how much is it
فِي زَوْجٍ وَأَبَوَيْنِ، مِنْ كَمْ هِيَ
Musannaf Ibn Abi Shaybah 31063
It is narrated from Akrama who said: Ibn Abbas (r.a) sent me to Zaid bin Thabit (r.a) to ask him about the inheritance of the husband and parents. He said that the husband gets half of the wealth, and the mother gets one-third of the remaining wealth, which is one-sixth of the total wealth. Ibn Abbas (r.a) sent a message to him, asking, "Do you find this in the Book of Allah?" He said, "I do not like to give preference to the mother over the father." Ibn Abbas (r.a) used to give the mother one-third of the entire wealth.
عکرمہ سے روایت ہے فرماتے ہیں کہ مجھے حضرت ابن عباس (رض) نے حضرت زید بن ثابت (رض) کے پاس شوہر اور والدین کے وارث ہونے کے مسئلے کے بارے میں دریافت کرنے کے لیے بھیجا، چنانچہ حضرت زید (رض) نے فرمایا کہ شوہر کے لیے آدھا مال ہے ، اور ماں کے لیے بقیہ مال کا ایک تہائی، اور وہ کل مال کا چھٹا حصّہ ہوگا، حضرت ابن عباس نے ان کے پاس پیغام بھیجا کہ کیا آپ اس بات کو کتاب اللہ میں پاتے ہیں ؟ انھوں نے فرمایا کہ میں اس بات کو ناپسند کرتا ہوں کہ ماں کو باپ پر ترجیح دوں ، اور حضرت ابن عباس (رض) ماں کو پورے مال کا ایک تہائی دیا کرتے تھے۔
Akram se riwayat hai farmate hain keh mujhe Hazrat Ibn Abbas (RA) ne Hazrat Zaid bin Sabit (RA) ke paas shohar aur waldain ke waris hone ke masle ke bare mein puchne ke liye bheja, chunancha Hazrat Zaid (RA) ne farmaya keh shohar ke liye aadha maal hai, aur maan ke liye baqaya maal ka ek tihai, aur woh kul maal ka chhata hissa hoga, Hazrat Ibn Abbas ne unke paas paigham bheja keh kya aap is baat ko kitab Allah mein pate hain? Unhon ne farmaya keh mein is baat ko napasand karta hun keh maan ko baap par tarjih dun, aur Hazrat Ibn Abbas (RA) maan ko pure maal ka ek tihai diya karte thay.
It is narrated from Zaida that Prophet Suleiman said that Prophet Ibrahim used to give the same answer to this question that Prophet Zaid (R.A.) used to give.
زائدہ سے روایت ہے کہ حضرت سلیمان نے فرمایا کہ حضرت ابراہیم اس مسئلے کا وہی جواب دیا کرتے تھے جو حضرت زید (رض) دیا کرتے تھے۔
Zaida se riwayat hai ki Hazrat Sulaiman ne farmaya ki Hazrat Ibrahim iss masle ka wahi jawab diya karte thay jo Hazrat Zaid (Razi Allahu Anhu) diya karte thay.
Hajjaj narrates from Hazrat Muhammad bin Hanafiyyah through a Sheikh that in the case of inheritance by the husband and parents, the husband is entitled to half of the wealth, the mother to one-third of the remaining wealth, and the rest goes to the father.
حجاج ایک شیخ کے واسطے سے حضرت محمد بن حنفیہ سے روایت کرتے ہیں کہ شوہر اور والدین کے وارث ہونے کی صورت میں شوہر کے لیے آدھا مال ہے اور ماں کے لیے بقیہ مال کا ایک تہائی، اور باقی مال باپ کے لیے ہے۔
Hujjaj aik sheikh kay wastay say Hazrat Muhammad bin Hanfia say riwayat karte hain kay shohar aur waldain kay waris honay ki soorat mein shohar kay liye aadha maal hai aur maan kay liye baqia maal ka aik tihai, aur baqi maal baap kay liye hai.
It is narrated from Ibrahim that Hazrat Ali (R.A) and Zaid bin Thabit (R.A) were asked about the issue of "wife and parents" and "husband and parents" that for mother, "one-third of the remaining property".
ابراہیم سے روایت ہے کہ حضرت علی (رض) اور زید بن ثابت (رض) نے ” بیوی اور والدین ‘ اور ” شوہر اور والدین “ کے مسئلے کے بارے میں ارشاد فرمایا کہ ماں کے لیے ” باقی بچنے والے مال کا ایک تہائی ہے۔ “
Ibraheem se riwayat hai keh Hazrat Ali (RA) aur Zaid bin Sabit (RA) ne "biwi aur waldain" aur "shohar aur waldain" ke masle ke baare mein irshad farmaya keh maan ke liye "baqi bachne wale maal ka aik tihai hai."
It is narrated from I'amash that Ibn 'Abbas (may Allah be pleased with him) sent a man to Zayd to inquire about the matter of the husband and parents. He said: "For the husband is half the wealth and for the mother is a third of the remaining wealth." Ibn 'Abbas (may Allah be pleased with him) asked: "Do you find a third of the remaining wealth for the mother in the Book of Allah?" Zayd said: "This is my opinion, Allah Almighty knows best."
Abu Bakr said: "It is six parts, three parts for the husband, one part for the mother, and two parts for the father."
اعمش سے روایت ہے کہ حضرت ابن عباس (رض) نے حضرت زید کے پاس شوہر اور والدین کے مسئلے کے بارے میں دریافت کرنے کے لیے آدمی بھیجا ، تو انھوں نے فرمایا : کہ شوہر کے لیے آدھا مال ہے اور ماں کے لیے بقیہ مال کا ایک تہائی، حضرت ابن عباس (رض) نے پوچھا کہ کیا کتاب اللہ میں آپ ماں کے لیے بقیہ مال کا ایک تہائی پاتے ہیں ؟ حضرت زید نے فرمایا کہ یہ میری رائے ہے اللہ تعالیٰ زیادہ بہتر جانتے ہیں۔
ابو بکر فرماتے ہیں کہ یہ چھ حصّے ہوتے ہیں، شوہر کے تین حصّے ، ماں کا ایک حصّہ ، اور باپ کے دو حصّے۔
Aamash se riwayat hai ki Hazrat Ibn Abbas (RA) ne Hazrat Zaid ke paas شوہر aur waldain ke masle ke bare mein دریافت karne ke liye aadmi bheja, tou unhon ne farmaya: Ki شوہر ke liye aadha maal hai aur maan ke liye baqiya maal ka aik tihaai, Hazrat Ibn Abbas (RA) ne poocha ki kya kitab Allah mein aap maan ke liye baqiya maal ka aik tihaai paate hain? Hazrat Zaid ne farmaya ki yeh meri raaye hai Allah ta'ala zyada behtar jaante hain.
Abu Bakr farmate hain ki ye chhe hisse hote hain, شوہر ke teen hisse, maan ka aik hissa, aur baap ke do hisse.
