كِتَابُ الْفَرَائِضِ

Regarding loyalty, who said: It goes to the eldest, saying: The closest to the deceased

‌فِي الْوَلَاءِ مَنْ قَالَ: هُوَ لِلْكِبَرِ يَقُولُ: الْأَقْرَبُ مِنَ الْمَيِّتِ

Shua'bi says that Shuraih used to consider Wala as the successor of the property. Shua'bi says that the people of Madinah used to say that Wala is for the elder.

شعبی فرماتے ہیں کہ شریح ولاء کو مال کے قائم مقام قرار دیتے تھے ، شعبی فرماتے ہیں کہ اھل مدینہ فرماتے تھے کہ ولاء بڑے کے لیے ہے۔

Shubi farmate hain ke Sharaeh wilayat ko maal ke qaem maqam qarar dete thay, Shubi farmate hain ke ahl Madina farmate thay ke wilayat bare ke liye hai.

حَدَّثَنَا وَكِيعٌ ، عَنْ أَبِي عَاصِمٍ ، عَنِ الشَّعْبِيِّ ، قَالَ : كَانَ شُرَيْحٌ يُجْرِي الْوَلَاءَ مَجْرَى الْمَالِ ، قَالَ الشَّعْبِيُّ : " وَأَهْلُ الْمَدِينَةِ يَقُولُونَ : الْوَلَاءُ لِلْكِبَرِ "
