كِتَابُ الْسير
On how the spoils of war are divided
فِي الْغَنِيمَةِ كَيْفَ تُقْسَمُ

It has been narrated from 'Ata that the share of Allah and His Messenger (peace and blessings of Allah be upon him) in the khums is one, and the Prophet of Allah (peace and blessings of Allah be upon him) would place this khums wherever he wished, keeping whatever he wished and removing whatever he wished.
حضرت عطاء سے مروی ہے کہ اللہ اور اس کے رسول (صلی اللہ علیہ وآلہ وسلم) کا حصہ خمس میں ایک ہی ہے، اللہ کے نبی (صلی اللہ علیہ وآلہ وسلم) اس خمس کو جہاں پسند فرماتے رکھتے، جو چاہتے اس میں سے رکھ دیتے اور جو چاہتے اٹھا لیتے۔
Hazrat Ata se marvi hai keh Allah aur uske Rasul (Sallallahu Alaihi Wasallam) ka hissa khums mein aik hi hai, Allah ke Nabi (Sallallahu Alaihi Wasallam) is khums ko jahan pasand farmate rakhte, jo chahte is mein se rakh dete aur jo chahte utha lete.
حَدَّثَنَا عَبْدُ الرَّحِيمِ بْنُ سُلَيْمَانَ ، عَنْ عَبْدِ الْمَلِكِ ، عَنْ عَطَاءٍ قَالَ : « خُمُسُ اللَّهِ ، وَخُمُسُ الرَّسُولِ ، وَاحِدٌ كَانَ النَّبِيُّ ﷺ يَضَعُ ذَلِكَ الْخُمُسَ حَيْثُ أَحَبَّ وَيَصْنَعُ مَا شَاءَ وَيَحْمِلُ فِيهِ مَنْ شَاءَ »
