Musannaf Ibn Abi Shaybah 36119
Hazrat Abu Burda narrated from his father that the Messenger of Allah (peace and blessings of Allah be upon him) said: There is no marriage without a guardian. And it has been mentioned that the saying of (Imam) Abu Hanifa is: If the husband is Kufu (equal), then this marriage is permissible.
حضرت ابو بردہ اپنے والد سے روایت بیان کرتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : ولی کے بغیر نکاح نہیں ہوتا۔ اور (امام) ابوحنیفہ کا قول یہ ذکر کیا گیا ہے کہ : اگر شوہر کفو (ہم پلہ) ہو تو یہ نکاح جائز ہے۔
Hazrat Abu Burda apne walid se riwayat bayan karte hain ke Rasul Allah (Sallallahu Alaihi Wasallam) ne irshad farmaya : Wali ke baghair nikah nahi hota. Aur (Imam) Abu Hanifa ka qaul ye zikr kiya gaya hai ke : Agar shohar kufu (hum pala) ho to ye nikah jaiz hai.
يَزِيدُ بْنُ هَارُونَ ، عَنْ إِسْرَائِيلَ ، عَنْ أَبِي إِسْحَاقَ ، عَنْ أَبِي بُرْدَةَ ، عَنْ أَبِيهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ ﷺ : « لَا نِكَاحَ إِلَّا بِوَلِيٍّ » وَذُكِرَ أَنَّ أَبَا حَنِيفَةَ كَانَ يَقُولُ ، جَائِزٌ إِذَا كَانَ كُفْئًا
