Musnad Ahmad ibn Hanbal 23697
Haram bin Muhaishah (may Allah be pleased with him) narrates from his father that the camel of Bara (may Allah be pleased with him) entered a garden and caused damage to it. So, the Holy Prophet (peace and blessings of Allah be upon him) gave the verdict that during the day, the protection of the garden is the responsibility of its owners, and if animals cause any damage at night, then the owner of the animal will be responsible for that damage.

حرام بن محیصہ ﷺ (اپنے والد سے) نقل کرتے ہیں کہ حضرت براء رضی اللہ عنہ کی اونٹنی نے ایک باغ میں داخل ہو کر اس میں تباہی مچا دی تو نبی کریم ﷺ نے یہ فیصلہ فرمایا کہ دن کے وقت باغ کی حفاظت اس کے مالکوں کے ذمے ہے اور اگر رات کو جانور کوئی نقصان پہنچاتے ہیں تو اس نقصان کا ضامن جانور کا مالک ہوگا۔
Haram bin Muhaysah (صلى الله عليه وآله وسلم) (apne walid se) naql karte hain keh Hazrat Bara (رضي الله تعالى عنه) ki untni ne ek bagh mein dakhil hokar is mein tabahi macha di to Nabi Kareem (صلى الله عليه وآله وسلم) ne yeh faisla farmaya keh din ke waqt bagh ki hifazat uske maalikon ke zimme hai aur agar raat ko janwar koi nuqsan pahunchate hain to us nuqsan ka zamin janwar ka malik hoga.
حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، حَدَّثَنَا مَعْمَرٌ ، عَنْ الزُّهْرِيِّ ، عَنْ حَرَامِ بْنِ مُحَيِّصَةَ ، عَنْ أَبِيهِ ،" أَنَّ نَاقَةً لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْهُ، فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى أَهْلِ الْأَمْوَالِ حِفْظَهَا بِالنَّهَارِ، وَعَلَى أَهْلِ الْمَوَاشِي حِفْظَهَا بِاللَّيْلِ" .
