Musnad Ahmad ibn Hanbal 4502
It is narrated on the authority of Sayyidna Ibn Umar (may Allah be pleased with them both) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever sells a tree in which date palms have been grafted, then its fruit will be the property of the seller, unless the buyer makes it a condition at the time of purchase (that I am buying this tree including its fruit)."

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ رسول اللہ ﷺ نے ارشاد فرمایا: ”جو شخص کسی ایسے درخت کو فروخت کرے جس میں کھجوروں کی پیوندکاری کی گئی ہو، تو اس کا پھل بائع (بچنے والا) کی ملیکت میں ہو گا الاّ یہ کہ مشتری (خریدنے والا) خریدتے وقت اس کی بھی شرط لگا دے (کہ میں یہ درخت پھل سمیت خرید رہا ہوں)۔“
Saidina Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki Rasul Allah (صلى الله عليه وآله وسلم) ne irshad farmaya: "Jo shakhs kisi aise darakht ko farokht kare jis mein khajuron ki paiwandkari ki gai ho, to uska phal ba'i (bechne wala) ki milkiyat mein ho ga illa yeh ki mushتري (kharidne wala) kharidte waqt uski bhi shart laga de (keh mein yeh darakht phal samet kharid raha hun).
حَدَّثَنَا إِسْمَاعِيلُ ، أَخْبَرَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَال: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" مَنْ بَاعَ نَخْلًا قَدْ أُبِّرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
