Musnad Ahmad ibn Hanbal 4504
It is narrated on the authority of Sayyiduna Ibn Umar (may Allah be pleased with them both) that I know that during the blessed era of the Holy Prophet (peace and blessings of Allah be upon him), land used to be given on rent in exchange for grass and a small amount of fodder, the quantity of which I do not remember. Sayyiduna Ibn Umar (may Allah be pleased with them both) himself also used to give land on rent during the eras of the Siddiqui, Farooqi, Uthmani, and the early period of the reign of Sayyiduna Ameer Muawiya (may Allah be pleased with him). However, during the latter part of Sayyiduna Muawiya's (may Allah be pleased with him) reign, he came to know that Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) narrates a prohibition from the Holy Prophet (peace and blessings of Allah be upon him) regarding giving land on rent. So he came to him, and I was also with him. They asked Sayyiduna Rafi' (may Allah be pleased with him) about it, and he said, "Yes! The Holy Prophet (peace and blessings of Allah be upon him) forbade giving land on rent." Upon hearing this, Sayyiduna Ibn Umar (may Allah be pleased with them both) abandoned this practice and never gave land on rent after that. And whenever someone would ask him about it, he would say that Sayyiduna Rafi' bin Khadij (may Allah be pleased with him) is of the opinion that the Holy Prophet (peace and blessings of Allah be upon him) forbade giving land on rent.

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ میں اس بات کو جانتا ہوں کہ نبی کریم ﷺ کے دور باسعادت میں گھاس اور تھوڑے سے بھوسے کے عوض زمین کو کر ایہ پر دے دیا جاتا تھا، جس کی مقدار مجھے یاد نہیں، خود سیدنا ابن عمر رضی اللہ عنہما بھی دور صدیقی و فاروقی و عثمانی اور سیدنا امیر معاویہ رضی اللہ عنہ کے ابتدائی دور حکومت میں زمین کرائے پر دیا کرتے تھے، لیکن سیدنا معاویہ رضی اللہ عنہ کے آخری دور میں انہیں پتہ چلا کہ سیدنا رافع بن خدیج رضی اللہ عنہ زمین کو کر ائے پر دینے میں نبی کریم ﷺ کی ممانعت روایت کرتے ہیں، تو وہ ان کے پاس آئے، میں بھی ان کے ساتھ تھا، انہوں نے سیدنا رافع رضی اللہ عنہ سے اس کے متعلق پوچھا: تو انہوں نے فرمایا کہ ہاں! نبی کریم ﷺ نے زمین کو کرائے پر دینے سے منع فرمایا ہے، یہ سن کر سیدنا ابن عمر رضی اللہ عنہما نے یہ کام چھوڑ دیا اور بعد میں وہ کسی کو بھی زمین کرائے پر نہ دیتے تھے، اور جب کوئی ان سے پوچھتا تو وہ فرما دیتے کہ سیدنا رافع بن خدیج رضی اللہ عنہ کا یہ خیال ہے کہ نبی کریم ﷺ نے زمین کو کر ائے پر دینے سے منع فرمایا ہے۔
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki mein is baat ko janta hun ki Nabi Kareem (صلى الله عليه وآله وسلم) ke daur ba saadat mein ghas aur thore se bhoose ke awaz zameen ko kiraye par de diya jata tha, jis ki miqdar mujhe yaad nahin, khud Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a bhi daur siddiqi wa farooqi wa usmani aur Sayyidna Ameer Muawiya (رضي الله تعالى عنه) ke ibtidai daur hukumat mein zameen kiraye par diya karte the, lekin Sayyidna Muawiya (رضي الله تعالى عنه) ke aakhri daur mein unhen pata chala ki Sayyidna Rafi bin Khadij (رضي الله تعالى عنه) zameen ko kiraye par dene mein Nabi Kareem (صلى الله عليه وآله وسلم) ki mamanat riwayat karte hain, to woh un ke pas aaye, mein bhi un ke sath tha, unhon ne Sayyidna Rafi (رضي الله تعالى عنه) se is ke mutalliq poocha: to unhon ne farmaya ki haan! Nabi Kareem (صلى الله عليه وآله وسلم) ne zameen ko kiraye par dene se mana farmaya hai, yeh sun kar Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a ne yeh kaam chhor diya aur baad mein woh kisi ko bhi zameen kiraye par na dete the, aur jab koi un se poochta to woh farma dete ki Sayyidna Rafi bin Khadij (رضي الله تعالى عنه) ka yeh khayal hai ki Nabi Kareem (صلى الله عليه وآله وسلم) ne zameen ko kiraye par dene se mana farmaya hai.
حَدَّثَنَا إِسْمَاعِيلُ ، أَخْبَرَنَا أَيُّوبُ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ: قَدْ عَلِمْتُ أَنَّ الْأَرْضَ كَانَتْ تُكْرَى عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهِ عَلَيْهِ وَسَلَّمَ بِمَا عَلَى الْأَرْبِعَاءِ وَشَيْءٍ مِنَ التِّبْنِ، لَا أَدْرِي كَمْ هُوَ، وَإِنَّ ابْنَ عُمَرَ، كَانَ يُكْرِي أَرْضَهُ فِي عَهْدِ أَبِي بَكْرٍ، وَعَهْدِ عُمَرَ وَعَهْدِ عُثْمَانَ، وَصَدْرِ إِمَارَةِ مُعَاوِيَةَ، حَتَّى إِذَا كَانَ فِي آخِرِهَا بَلَغَهُ أَنَّ رَافِعًا يُحَدِّثُ فِي ذَلِكَ بِنَهْيِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَأَتَاهُ وَأَنَا مَعَهُ، فَسَأَلَهُ، فَقَالَ: نَعَمْ،" نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ كِرَاءِ الْمَزَارِعِ، فَتَرَكَهَا ابْنُ عُمَر، فَكَانَ لَا يُكْرِيهَا، فَكَانَ إِذَا سُئِلَ يَقُول: زَعَمَ ابْنُ خَدِيجٍ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ" نَهَى عَنْ كِرَاءِ الْمَزَارِعِ".
