Musnad Ahmad ibn Hanbal 6119
Anas bin Sirin narrates that once I asked Abdullah ibn Umar (may Allah be pleased with him) to tell me about the incident of his divorce. He said: I divorced my wife during her menstrual period. Umar Farooq (may Allah be pleased with him) mentioned this to the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) said: Tell him to take his wife back, and when she is pure, he may divorce her during her purity. I asked Ibn Umar, "Did you count that divorce which you pronounced during the menses?" He said, "Why would I not count it? Had I not done so, people would have considered me a fool."

انس بن سیرین کہتے ہیں کہ ایک مرتبہ سیدنا ابن عمر رضی اللہ عنہما سے عرض کیا کہ اپنی زوجہ کو طلاق دینے کا واقعہ تو سنایئے انہوں نے فرمایا: کہ میں نے اپنی بیوی کو " ایام " کی حالت میں طلاق دے دی سیدنا عمر فاروق رضی اللہ عنہ نے نبی ﷺ سے اس کا تذکر ہ کیا تو انہوں نے فرمایا: اسے کہو کہ اپنی بیوی سے رجوع کر لے، جب وہ " پاک " ہو جائے تو ان ایام طہارت میں اسے طلاق دے دے۔ میں نے پوچھا کہ کیا آپ نے وہ طلاق شمار کی تھی جو " ایام " کی حالت میں دی تھی؟ انہوں نے کہا کہ اسے شمار نہ کرنے کیا وجہ تھی؟ اگر میں ایسا کرتا تو لوگ مجھے بیوقوف سمجھتے۔
Ans bin Sirin kahte hain kay aik martaba Sayidna Ibn Umar (RA) say arz kia kay apni zauja ko talaq dainay ka waqia to sunaiye. Unhon ne farmaya: Kay main ne apni biwi ko "ayyam" ki halat mein talaq de di. Sayidna Umar Farooq (RA) ne Nabi (SAWW) say is ka tazkira kia to unhon ne farmaya: Isay kaho kay apni biwi say ruju kar lay, jab woh "paak" ho jaye to un ayam tahaarat mein usay talaq de de. Main ne poocha kay kia aap ne woh talaq shumar ki thi jo "ayyam" ki halat mein di thi? Unhon ne kaha kay isay shumar na karne ki kia waja thi? Agar main aisa karta to log mujhe bewakoof samjhte.
حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ ، حَدَّثَنَا عَبْدُ الْمَلِكِ يَعْنِي ابْنَ أَبِي سُلَيْمَانَ ، عَنْ أَنَسِ بْنِ سِيرِينَ ، عَنْ ابْنِ عُمَرَ ، قَالَ: سَأَلْتُهُ عَنِ امْرَأَتِهِ الَّتِي طَلَّقَ عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: طَلَّقْتُهَا وَهِيَ حَائِضٌ، فَذَكَرْتُ ذَلِكَ لِعُمَرَ، فَذَكَرَهُ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" مُرْهُ فَلْيُرَاجِعْهَا، إِذَا طَهُرَتْ طَلَّقَهَا فِي طُهْرِهَا لِلسُّنَّةِ"، قَالَ: فَفَعَلْتُ , قَالَ أَنَسٌ: فَسَأَلْتُهُ , هَلْ اعْتَدَدْتَ بِالَّتِي طَلَّقْتَهَا وَهِيَ حَائِضٌ؟ قَالَ: وَمَا لِي لَا أَعْتَدُّ بِهَا، إِنْ كُنْتُ عَجَزْتُ وَاسْتَحْمَقْتُ!!.
