Musnad Ahmad ibn Hanbal 6141
It is narrated by Sayyiduna Ibn Umar (may Allah be pleased with him) that I divorced my wife during her menstrual period. Sayyiduna Umar (may Allah be pleased with him) went and told this to the Prophet (peace and blessings of Allah be upon him). The Prophet (peace and blessings of Allah be upon him) became very angry and said: "Tell him to take her back, then if he wants to divorce her, he should divorce her during a period of purity before approaching her. This is the way of divorce which Allah has permitted." Because Sayyiduna Ibn Umar (may Allah be pleased with him) had already divorced her, it was counted. Sayyiduna Ibn Umar (may Allah be pleased with him) took her back according to the order of the Prophet (peace and blessings of Allah be upon him). (The Prophet) said, "Do you want to prove him foolish and stupid (why wouldn't the divorce be valid)?"

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ میں نے اپنی بیوی کو ایام کی حالت میں طلاق دے دی تھی سیدنا عمر رضی اللہ عنہ نے جا کرنبی ﷺ کو یہ بات بتائی تو نبی ﷺ سخت ناراض ہوئے اور فرمایا: اسے کہو کہ وہ اس سے رجوع کر لے پھر اگر وہ اسے طلاق دینا ہی چاہے تو اس کے قریب جانے پہلے طہر کی دوران دے یہ طلاق کا وہ طریقہ ہے جس کے مطابق اللہ نے طلاق دینے کی اجازت دی ہے چونکہ سیدنا ابن عمر رضی اللہ عنہما نے اسے طلاق دے دی تھی لہٰذا اسے شمار کیا گیا اور سیدنا ابن عمر رضی اللہ عنہما نے نبی ﷺ کے حکم کے مطابق اس سے رجوع کر لیا فرمایا: یہ بتاؤ کیا تم اسے بیوقوف اور احمق ثابت کرنا چاہتے ہو (طلاق کیوں نہ ہو گی)
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki maine apni biwi ko ayyam ki halat mein talaq de di thi. Sayyidna Umar (رضي الله تعالى عنه) ne ja kar Nabi (صلى الله عليه وآله وسلم) ko yeh baat batai to Nabi (صلى الله عليه وآله وسلم) sakht naraz hue aur farmaya: Use kaho ki woh us se ruju kar le phir agar woh use talaq dena hi chahe to us ke qareeb jane pehle tahur ki dauran de. Yeh talaq ka woh tareeqa hai jis ke mutabiq Allah ne talaq dene ki ijazat di hai. Chunki Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a ne use talaq de di thi lahaza use shumar kiya gaya aur Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a ne Nabi (صلى الله عليه وآله وسلم) ke hukum ke mutabiq us se ruju kar liya. Farmaya: Yeh batao kya tum use bewqoof aur ahmaq sabit karna chahte ho (talaq kyun na ho gi).
حَدَّثَنَا يَعْقُوبُ ، أَخْبَرَنِي ابْنُ أَخِي ابْنِ شِهَابٍ ، عَنْ عَمِّهِ ، أَخْبَرَنَا سَالِمُ بْنُ عَبْدِ اللَّهِ ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ ، قَالَ: طَلَّقْتُ امْرَأَتِي وَهِيَ حَائِضٌ، فَذَكَرَ عُمَرُ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: فَتَغَيَّظَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ قَالَ:" لِيُرَاجِعْهَا حَتَّى تَحِيضَ حَيْضَةً مُسْتَقْبَلَةً سِوَى حَيْضَتِهَا الَّتِي طَلَّقَهَا فِيهَا، فَإِنْ بَدَا لَهُ أَنْ يُطَلِّقَهَا، فَلْيُطَلِّقْهَا طَاهِرًا مِنْ حَيْضَتِهَا قَبْلَ أَنْ يَمَسَّهَا، فَذَلِكَ الطَّلَاقُ لِلْعِدَّةِ، كَمَا أَمَرَ اللَّهُ تَعَالَى"، وَكَانَ عَبْدُ اللَّهِ طَلَّقَهَا تَطْلِيقَةً، فَحُسِبَتْ مِنْ طَلَاقِهَا، وَرَاجَعَهَا عَبْدُ اللَّهِ كَمَا أَمَرَهُ.
