Musnad Ahmad ibn Hanbal 6380
It is narrated on the authority of Sayyidina Ibn Umar (may Allah be pleased with him) that the Holy Prophet (peace and blessings of Allah be upon him) said: “Whoever sells a wealthy slave, all his wealth will belong to the seller, unless the buyer makes a condition. And whoever sells palm trees that have been grafted, their fruits will also belong to the seller, unless the buyer makes a condition.”

سیدنا ابن عمر رضی اللہ عنہما سے مروی ہے کہ نبی کریم ﷺ نے ارشاد فرمایا: ”جو شخص کسی مالدار غلام کو بیچے تو اس کا سارا مال بائع (بچنے والا) کا ہو گا الاّ یہ کہ مشتری (خریدنے والا) شرط لگادے اور جو شخص پیوند کاری کئے ہوئے کھجوروں کے درخت بیچتا ہے تو اس کا پھل بھی بائع (بچنے والا) کا ہو گا الاّ یہ کہ مشتری (خریدنے والا) شرط لگادے۔
Sayyidna Ibn Umar ( (رضي الله تعالى عنه) a se marvi hai ki Nabi Kareem (صلى الله عليه وآله وسلم) ne irshad farmaya: ”Jo shakhs kisi maldar ghulam ko beche to uska sara maal baie (bechne wala) ka hoga illa ye ki mushtari (kharidne wala) shart laga de aur jo shakhs paiwand kari kiye huye khajuron ke darakht bechta hai to uska phal bhi baie (bechne wala) ka hoga illa ye ki mushtari (kharidne wala) shart lagae.
حَدَّثَنَا عَبْدُ الرَّزَّاقِ ، حَدَّثَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ سَالِمٍ ، عَنِ ابْنِ عُمَرَ ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" مَنْ بَاعَ عَبْدًا فَمَالُهُ لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ، وَمَنْ بَاعَ نَخْلًا فِيهَا ثَمَرَةٌ قَدْ أُبِرَتْ، فَثَمَرَتُهَا لِلْبَائِعِ، إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ".
