Chapter on permission for one who enters Mecca without Ihram, even if not fearing war.
باب من رخص في دخولها بغير إحرام وإن لم يكن محاربا
Sunan al-Kubra Bayhaqi 9844
Nafi' narrates that Abdullah bin Umar (may Allah be pleased with him) came to Makkah. When he reached a place called "Qadeed", he received some news from Madinah and turned back. He entered Makkah without being in the state of Ihram.

(٩٨٤٤) نافع فرماتے ہیں کہ عبداللہ بن عمر (رض) مکہ آئیجب، ” قدید “ نامی جگہ آئے تو ان کو مدینہ سے کوئی خبر ملی تو واپس لوٹ گئے اور مکہ میں بغیر احرام کے داخل ہوئے۔
(9844) Nafe farmate hain keh Abdullah bin Umar (RA) Makkah aai jab, "Qadeed" nami jaga aaye to un ko Madinah se koi khabar mili to wapas laut gaye aur Makkah mein baghair ehram ke dakhil huwe.
Imam Malik narrates from Ibn Shihab that he was asked about a person who enters Mecca without being in the state of Ihram, he said: I do not see any harm in it.

(٩٨٤٥) امام مالک ابن شہاب سے نقل فرماتے ہیں کہ ان سے اس شخص کے بارے میں سوال کیا گیا جو بغیر احرام کے مکہ میں داخل ہوتا ہے تو فرمانے لگے : میں اس میں کوئی حرج محسوس نہیں کرتا۔
(9845) Imam Malik Ibn Shahab se naqal farmate hain ke un se is shakhs ke bare mein sawal kya gaya jo baghair ehram ke Makkah mein dakhil hota hai to farmane lage : mein is mein koi harj mehsoos nahin karta.
(9846) Narrated Abdullah bin Abu Qatadah that his father told him that he participated along with the Prophet (ﷺ) in the Ghazwa of Hudaibiya. Others along with me put on the Ihram (garb) of `Umrah. I, meanwhile, hunted a wild ass and fed my companions, who were Muhrim. Then I came to the Prophet (ﷺ) and informed him about it, and we still had some leftover meat. You (ﷺ) said, "Eat it." And all of us were Muhrim.
(b) Narrated Abu Muhammad, the freed slave of Abu Qatadah, from Abu Qatadah (RA) that we went out with the Messenger of Allah (ﷺ). When we reached a place called "Qaha" some of us were in the state of Ihram and some were not.

(٩٨٤٦) عبداللہ بن ابوقتادہ کو ان کے والد نے خبر دی کہ انھوں نے نبی (صلی اللہ علیہ وآلہ وسلم) کے ساتھ مل کر غزوہ حدیبیہ میں حصہ لیا۔ میرے علاوہ دوسروں نے عمرہ کا احرام باندھا، تو میں وحشی گدھے کا شکار کیا تو میں نے اپنے محرم ساتھیوں کو کھلا دیا۔ پھر میں نے آکر نبی (صلی اللہ علیہ وآلہ وسلم) کو خبر دی اور ہمارے پاس زائد گوشت بھی تھا۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : کھاؤ اور وہ سب محرم تھے۔
(ب) ابوقتادہ کے غلام ابو محمد حضرت ابوقتادہ (رض) سے نقل فرماتے ہیں کہ ہم رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے ساتھ نکلے ۔ جب ہم ” قاحہ “ نامی جگہ آئے تو ہم سے بعض محرم تھے اور بعض غیر محرم۔
(9846) Abdullah bin Abuqataada ko un ke walid ne khabar di ke unhon ne Nabi ((صلى الله عليه وآله وسلم)) ke saath mil kar Ghazwa Hudaibiya mein hissa liya mere alawa dusron ne Umrah ka ahram bandha to mein wahshi gadhe ka shikar kiya to mein ne apne muhrim sathion ko khila diya phir mein ne aakar Nabi ((صلى الله عليه وآله وسلم)) ko khabar di aur humare pass zaid gosht bhi tha aap ((صلى الله عليه وآله وسلم)) ne farmaya khao aur wo sab muhrim thay
(b) Abuqataada ke ghulam Abu Muhammad Hazrat Abuqataada (Razi Allahu Anhu) se naqal farmate hain ke hum Rasul Allah ((صلى الله عليه وآله وسلم)) ke saath nikle jab hum Qaha nami jaga aye to hum se baz muhrim thay aur baz ghair muhrim
