Chapter on what is narrated about forfeiting the pledge

Saeed bin Musayyab narrates that the Messenger of Allah (peace and blessings of Allah be upon him) said: "The pledge should not be kept in possession, so the pledger will be prohibited from buying from the person to whom he has given something in pledge." I have found the same in my book, and in my opinion, the correct interpretation is that the pledger should not be prohibited from buying the thing that has been pledged. And Allah knows best.

(١١٢٣٧) حضرت سعید بن مسیب فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : رہن کو قبضے میں نہ رکھا جائے، اس لیے رہن والے کو منع کیا جائے گا کہ وہ خریدے اس شخص سے جیسے اس نے رہن میں کوئی چیز دی ہے میں نے اسی طرح اپنی کتاب میں پایا ہے اور میری نظر میں درست یہ ہے کہ اس کا مطلب یہ ہے کہ گروی رکھنے والے کو منع نہ کیا جائے کہ وہ گروی رکھی گئی چیز کو خریدے۔ واللہ اعلم
Hazrat Saeed bin Musayyab farmate hain ki Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya : Rehan ko qabze mein na rakha jaye, is liye rehan wale ko mana kiya jaye ga ki wo kharede us shakhs se jaise us ne rehan mein koi cheez di hai maine isi tarah apni kitab mein paya hai aur meri nazar mein durust ye hai ki is ka matlab ye hai ki giro rakhne wale ko mana na kiya jaye ki wo giro rakhi gai cheez ko kharede. Wallahu Alim.
Abdullah bin Ja'far reported that the Messenger of Allah (ﷺ) said: "The mortgaged property should not be withheld (from its owner after the payment of the debt)." A man mortgaged his house in Medina for a certain period, and when the time for payment came, the mortgagee said: "The house now belongs to me." The Messenger of Allah (ﷺ) said: "Do not withhold the mortgaged property (from its owner after the debt has been paid)." This Hadith is mursal (the narrator does not mention the name of the Companion who narrated it from the Prophet).

(١١٢٣٨) حضرت عبداللہ بن جعفر فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : رہن قبضے میں نہ رکھی جائے اور ایک آدمی نے مدینہ میں ایک مدت تک کے لیے گھر گروی رکھا اور جب ادائیگی کا وقت آیا تو گروی لینے والے نے کہا : اب یہ گھر میرا ہے تو رسول (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : رہن کو روکا نہ جائے۔ یہ مرسل ہے۔
Hazrat Abdullah bin Jaffar farmate hain ki Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Rehan qabze mein na rakhi jaye aur ek aadmi ne Madinah mein ek muddat tak ke liye ghar girawi rakha aur jab adaygi ka waqt aaya to girawi lene wale ne kaha: Ab yeh ghar mera hai to Rasool ((صلى الله عليه وآله وسلم)) ne farmaya: Rehan ko roka na jaye. Yeh mursal hai.
Mu'ammar said: I asked Imam Zuhri (may Allah have mercy on him) the meaning of "La yughliqul-rahn" so he said: It means that the person says: If I am unable to pay by such and such day then this pledged item will be yours.

(١١٢٣٩) معمر فرماتے ہیں میں نے امام زہری (رح) سے ” لا یغلق الرھن “ کا مطلب پوچھا تو انھوں نے فرمایا : اس کا مطلب یہ ہے کہ آدمی کہے : اگر میں فلاں دن تک ادا نہ کرسکوں تو یہ گروی چیز تیری ہوگی ۔
Muammar farmate hain main ne Imam Zuhri (rah) se "la yaghli-l-rahnu" ka matlab poocha to unhon ne farmaya: is ka matlab ye hai ki aadmi kahe: agar main falan din tak ada na karsakon to ye girovi cheez teri hogi.
