Chapter on Who Cultivated on a Land Unpermitted or with His Permit by the Way of Farming
باب من زرع في أرض غيره بغير إذنه أو بإذنه على سبيل المزارعة
Sunan al-Kubra Bayhaqi 11742
It is narrated from Rafi' bin Khadij (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: “Whoever cultivates the land of a people without their permission, there is no share for him in the cultivation, and he will only be given back his expenses.”

(١١٧٤٢) رافع بن خدیج (رض) سے منقول ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے کسی قوم کی زمین میں ان کی اجازت کے بغیر مزارعت کی اس کے لیے زراعت میں کوئی حصہ نہیں ہے اور اسے صرف اس کا خرچ دیا جائے گا۔
Rafi bin Khadij (rz) se manqol hai ki Rasool Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jis ne kisi qaum ki zameen mein un ki ijazat ke baghair muzaraat ki us ke liye ziraat mein koi hissa nahi hai aur use sirf us ka kharch diya jaye ga.
Rafi' bin Khadij (may Allah be pleased with him) reported: I cultivated the land of so-and-so. The Messenger of Allah (peace and blessings of Allah be upon him) passed by me while I was irrigating the fields. He asked: "Whose fields are these?" Rafi' said: "The crops are mine and the land belongs to so-and-so. I took it on a sharecropping basis, half for me and half for him." He (peace and blessings of Allah be upon him) said: "Dust off your hands from it and give the land back to its owner and take your expenses." Rafi' said: "I went to him and informed him of what the Messenger of Allah (peace and blessings of Allah be upon him) had said, and I took my expenses and returned his land to him."

(١١٧٤٤) رافع بن خدیج (رض) نے خبر دی کہ انھوں نے بنی فلاں کی زمین میں زراعت کی۔ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) میرے پاس سے گزرے اور میں کھیتوں کو پانی دے رہا تھا۔ آپ نے پوچھا : یہ کس کے کھیت ہیں ؟ رافع نے کہا : کھیت میرے ہیں اور زمین بنی فلاں کی ہے میں نے اس سے نصف پر لی ہے اور نصف اس کا ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اس کے غبار سے اپنے ہاتھوں کو جھاڑلے اور زمین مالک کو دے دے اور اپنا خرچہلے لے۔ رافع کہتے ہیں : میں گیا میں نے ان کو خبر دی جو رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے کہا اور اپنا خرچ لیا اور ان کو ان کی زمین لوٹادی۔
11744 Rafi bin Khadij (RA) ne khabar di ke unhon ne Bani Fulan ki zameen mein ziraat ki. Rasul Allah (SAW) mere paas se guzre aur mein khetoun ko pani de raha tha. Aap ne poocha: Ye kis ke khet hain? Rafi ne kaha: Khet mere hain aur zameen Bani Fulan ki hai maine is se nisf par li hai aur nisf is ka hai. Aap (SAW) ne farmaya: Is ke ghubar se apne hathoun ko jhaarle aur zameen malik ko de de aur apna kharcha le le. Rafi kahte hain: Mein gaya mein ne un ko khabar di jo Rasul Allah (SAW) ne kaha aur apna kharcha liya aur un ko un ki zameen luta di.
Abu Ja'far Khatmi reported: My paternal uncle sent me along with his slave to Sa'id b. Musayyab. We said to him: We have heard something from you about agriculture. He said: Ibn 'Umar saw no harm in it until this tradition of Rafi' reached him. You came to Rafi' and he told that you went to Banu Haritha and you saw the cultivation in the land of Zahir. You said: How fine is the cultivation of Zahir! They said: It is not the cultivation of Zahir. You said: Is it not the land of Zahir? They replied: The land belongs to Zahir, but the cultivation belongs to so and so. You (the Holy Prophet) said: Take your cultivation and return the expenses. Rafi' said: We took our cultivation and returned the expenses. Sa'd said: Give (the produce) to your brother or give it on rent in exchange for dirhams.

(١١٧٤٥) ابو جعفر خطمی فرماتے ہیں : مجھے میرے چچانے اپنے ایک غلام کے ساتھ سعید بن مسیب (رح) کی طرف بھیجا، ہم نے ان سے پوچھا کہ زراعت کے بارے میں آپ سے ہمیں کچھ خبر ملی ہے تو انھوں نے کہا : ابن عمر اس میں کوئی حرج نہ سمجھتے تھے، یہاں تک کہ ان کو رافع کی حدیث ملی۔ آپ رافع کے پاس آئے تو رافع نے بتایا کہ آپ بنی حارثہ کے پاس آئے اور آپ نے ظہیر کی زمین میں زراعت دیکھی۔ آپ نے کہا : کتنی اچھی کھیتی ہے ظہیر کی۔ انھوں نے کہا : یہ کھیتی ظہیر کی نہیں ہے۔ آپ نے پوچھا : کیا یہ ظہیر کی زمین نہیں ہے ؟ انھوں نے جواب دیا : زمین ظہیر کی ہے لیکن کھیتی فلاں کی ہے۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : اپنی زراعت لے لو اور خرچ لوٹادو۔ رافع نے کہا : ہم نے اپنی کھیتی لے لی اور خرچہ لوٹادیا۔ سعد کہتے ہیں : اپنے بھائی کو دے دو یا درہموں کے بدلے کرایہ پردے دو ۔
(11745) Abu Jaffar Khatmi farmate hain : mujhe mere chachan ne apne ek gulam ke sath Saeed bin Mussib (rah) ki taraf bheja, hum ne un se pucha ke ziraat ke bare mein aap se humein kuch khabar mili hai to unhon ne kaha : Ibn Umar is mein koi harj na samajhte the, yahan tak ke un ko Rafi ki hadees mili. Aap Rafi ke paas aaye to Rafi ne bataya ke aap Bani Haritha ke paas aaye aur aap ne Zaheer ki zameen mein ziraat dekhi. Aap ne kaha : kitni acchi kheti hai Zaheer ki. Unhon ne kaha : yeh kheti Zaheer ki nahin hai. Aap ne pucha : kya yeh Zaheer ki zameen nahin hai ? Unhon ne jawab diya : zameen Zaheer ki hai lekin kheti falan ki hai. Aap ((صلى الله عليه وآله وسلم)) ne farmaya : apni ziraat le lo aur kharch lauta do. Rafi ne kaha : hum ne apni kheti le li aur kharcha lauta diya. Saad kahte hain : apne bhai ko de do ya dirham ke badle kiraya par de do.
Rafi' bin Khadij (may Allah be pleased with him) reported that the Messenger of Allah (peace and blessings of Allah be upon him) said: “He who cultivates the land of a people without their permission has no right to the cultivation and he should be given the price of his expenses.”

(١١٧٤٦) رافع بن خدیج (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے کسی قوم کی زمین میں ان کی اجازت کے بغیر زراعت کی اس کے لیے زراعت میں کوئی حصہ نہیں ہے اور اسے اس کے خرچ کی قیمت دے دی جائے گی۔
Rafi bin Khadij (RA) se riwayat hai ki Rasulullah (SAW) ne farmaya: Jisne kisi qaum ki zameen mein un ki ijazat ke baghair ziraat ki uske liye ziraat mein koi hissa nahi hai aur use uske kharch ki qeemat de di jayegi.
