Chapter on the inheritance of brothers and sisters through the mother
باب فرض الإخوة والأخوات للأم
Sunan al-Kubra Bayhaqi 12322
Sa'd used to recite this verse: {And if a man or a woman leaves property to be inherited and he (or she) has a brother or a sister} (referring to inheritance) from the mother's side.

(١٢٣٢٢) سعد یہ آیت پڑھتے تھے : { وَإِنْ کَانَ رَجُلٌ یُورَثُ کَلاَلَۃً أَوِ امْرَأَۃٌ وَلَہُ أَخٌ أَوْ أُخْتٌ} ماں کی طرف سے۔

Saeed ibn Qatada reported that Abu Bakr As-Siddiq (may Allah be pleased with him) said in his sermon: Beware! This verse, which is at the beginning of Surah An-Nisa, is about inheritance. It was revealed about children and parents, and the second verse in Surah An-Nisa, Allah Almighty revealed it about husband and wife and for the maternal brother, and the verse at the end of Surah An-Nisa, Allah Almighty revealed it about the real brother.

(١٢٣٢٣) سعید بن قتادہ نے بیان کیا کہ حضرت ابوبکر صدیق (رض) نے اپنے خطبہ میں کہا : خبردار ! یہ آیت جو سورة النساء کے شروع میں ہے وہ فرائض کے بارے میں ہے۔ اس کو اولاد اور والدین کے بارے میں نازل کیا اور دوسری آیت جو سورة النساء میں ہے اسے اللہ تعالیٰ نے خاوند اور بیوی کے بارے نازل کیا اور اخیافی بھائی کے لیے اور جو آیت سورة النساء کے آخر میں ہے اس میں اللہ تعالیٰ نے حقیقی بھائی کے بارے میں نازل کیا۔
Saeed bin Qatada ne bayan kya keh Hazrat Abubakar Siddique (RA) ne apne khutba mein kaha: Khabar dar! Yeh ayat jo sura e Nisa ke shuru mein hai woh faraiz ke bare mein hai. Iss ko aulad aur walidain ke bare mein nazil kya aur dusri ayat jo sura e Nisa mein hai issay Allah Ta'ala ne khawanad aur biwi ke bare nazil kya aur akhyafi bhai ke liye aur jo ayat sura e Nisa ke akhir mein hai iss mein Allah Ta'ala ne haqeeqi bhai ke bare mein nazil kya.
Zayd b. Thabit reported on the authority of his father that the share of a paternal brother's son from the inheritance is that they will not inherit with the children of the deceased, whether male or female, nor with the father, grandfather, and above that, he/she (paternal brother's son/daughter) gets one-sixth if he or she is alone. If they are more than one, male or female, then they will get one-third, which they will divide equally.

(١٢٣٢٤) خارجہ بن زید اپنے والد سے نقل فرماتے ہیں کہ اخیافی بھائی کی وراثت یہ ہے وہ والد اور بیٹے کی اولاد خواہ مذکر ہو یا مونث کے ساتھ وارث نہیں بنیں گے اور نہ ہی باپ، دادا کے ساتھ اور اس کے علاوہ ایک کے لیے سدس ہے، مذکر ہو یا مونث۔ پس اگر وہ ایک سے زائد ہوں تو مذکر ہوں یا مونث ثلث کے وارث ہوں گے برابر میں تقسیم کرلیں گے۔
