Chapter on the inheritance of a cousin's sons, where one is a son-in-law and the other is a brother of the mother
باب ميراث ابني عم أحدهما زوج والآخر أخ لأم
Sunan al-Kubra Bayhaqi 12376
(12376) Narrated Ibn 'Abbas (may Allah be pleased with him): The Messenger of Allah (peace be upon him) said: Give the shares of inheritance to those entitled to them. Whatever remains after giving the shares, should be given to the nearest male heir.

(١٢٣٧٦) حضرت ابن عباس (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : فرائض کو ان کے اہل تک پہنچاؤ ۔ جو فرائض بچ جائے وہ قریبی مذکر آدمی کو دے دو ۔
Hazrat Ibn Abbas (RA) se riwayat hai ki Rasul Allah (SAW) ne farmaya: Faraiz ko un ke ehl tak pohanchao. Jo faraiz bach jaye wo qareebi muzakkar aadmi ko de do.
Hakim bin Aaqal narrated: Shareeh was approached regarding a woman who left behind two sons of her paternal uncle. One of them was her husband and the other was her cousin. So Shareeh gave half to the husband and the remaining to the cousin. This matter reached Ali (R.A.), so he summoned Shareeh and said: "What judgment did you give?" Shareeh replied: "I gave half to the husband and the remaining to the cousin." Ali (R.A.) said: "Is this judgment according to the Book of Allah or the Sunnah of Rasulullah (S.A.W.)?" Shareeh replied: "According to the Book of Allah." Ali (R.A.) asked: "Where?" Shareeh recited: {And those of kin are nearer one to another in the Book of Allah}. Ali (R.A.) said: "Half is for the husband, so for whom is the remaining?" Then Ali (R.A.) gave half to the husband, one-sixth to the cousin, and then divided the rest between the two.

(١٢٣٧٧) حکیم بن عقال فرماتے ہیں : شریح کو ایسی عورت کے پاس لایا گیا جس نے اپنے چچا کے دو بیٹے چھوڑے تھے۔ ان میں سے ایک اس کا خاوند تھا اور دوسرا اس کا اخیافی بھائی تھا تو شریح نے خاوند کو نصف دیا اور باقی اخیافی بھائی کو دے دیا۔ حضرت علی (رض) کو یہ بات پہنچی تو انھوں نے شریح کو بلایا اور کہا : آپ نے کیا فیصلہ کیا ؟ شریح نے کہا : میں نے خاوند کو نصف دیا ہے اور اخیافی بھائی کو باقی ماندہ دیا ہے۔ حضرت علی (رض) نے کہا : کتاب اللہ کے ساتھ یہ فیصلہ کیا ہے یا سنت رسول اللہ (صلی اللہ علیہ وآلہ وسلم) سے ؟ شریح نے کہا : کتاب اللہ کے ساتھ، حضرت علی (رض) نے پوچھا : کہاں ؟ شریح نے { وَأُولُو الأَرْحَامِ بَعْضُہُمْ أَوْلَی بِبَعْضٍ فِی کِتَابِ اللَّہِ } حضرت علی (رض) نے کہا : زوج کے لیے نصف کہا اور باقی کس کے لیے ہے ؟ پھر حضرت علی (رض) نے زوج کو نصف دیا اور اخیافی بھائی کو سدس دیا۔ پھر باقی دونوں میں تقسیم کردیا۔
12377 Hakeem bin Akal farmate hain: Shuraih ko aisi aurat ke paas laya gaya jisne apne chacha ke do bete chhode the. In mein se ek uska khaavand tha aur dusra uska akhiafi bhai tha to Shuraih ne khaavand ko nisf diya aur baqi akhiafi bhai ko de diya. Hazrat Ali (RA) ko yeh baat pahunchi to unhon ne Shuraih ko bulaya aur kaha: Aap ne kya faisla kiya? Shuraih ne kaha: Maine khaavand ko nisf diya hai aur akhiafi bhai ko baqi mandah diya hai. Hazrat Ali (RA) ne kaha: Kitab Allah ke sath yeh faisla kya hai ya Sunnat Rasul Allah ((صلى الله عليه وآله وسلم)) se? Shuraih ne kaha: Kitab Allah ke sath. Hazrat Ali (RA) ne poocha: Kahan? Shuraih ne { waولو الأرحام بعضهم أولى ببعض فى كتاب الله }. Hazrat Ali (RA) ne kaha: Zauj ke liye nisf kaha aur baqi kis ke liye hai? Phir Hazrat Ali (RA) ne zauj ko nisf diya aur akhiafi bhai ko suds diya. Phir baqi donon mein taqseem kar diya.
It is narrated on the authority of Ali (may Allah be pleased with him) that he was brought before the two sons of his paternal uncle. One of them was a consanguine brother. It was said to Ali (may Allah be pleased with him): "Abdullah used to give all his wealth to his consanguine brother." Ali (may Allah be pleased with him) said: "May Allah have mercy on him, although he was a jurist. If it were me, I would have given one-sixth to the consanguine brother and then divided the rest between the two."

(١٢٣٧٨) حضرت علی (رض) سے روایت ہے کہ ان کو چچا کے دو بیٹوں کے پاس لایا گیا، ان میں سے ایک اخیافی بھائی تھا، حضرت علی (رض) سے کہا گیا : عبداللہ اخیافی بھائی کو سارا مال دیتے تھے، حضرت علی (رض) نے کہا : اللہ اس پر رحم کرے، اگرچہ وہ فقیہ تھے، اگر میں ہوتا تو اخیافی بھائی کو سدس دیتا پھر باقی دونوں میں تقسیم کردیتا۔
(12378) Hazrat Ali (RA) se riwayat hai ke un ko chacha ke do beton ke paas laya gaya, un mein se ek akhiafi bhai tha, Hazrat Ali (RA) se kaha gaya : Abdullah akhiafi bhai ko sara maal dete thay, Hazrat Ali (RA) ne kaha : Allah us per reham kare, agarche woh faqih thay, agar mein hota to akhiafi bhai ko suds deta phir baqi donon mein taqsim karta.
There is a narration from Sha'bi that if a woman leaves behind two sons of her paternal uncle, one being her husband and the other her (step)brother, according to the opinion of Ali and Zaid (may Allah be pleased with them), the husband will inherit half and the stepbrother will inherit one-sixth, and they both will share the remainder. And according to Abdullah (may Allah be pleased with him), the husband will inherit half and the remaining entire portion will go to the stepbrother.

(١٢٣٧٩) شعبی سے روایت ہے کہ جو عورت چچا کے دو بیٹے چھوڑے ان میں سے ایک اس کا خاوند ہو اور دوسرا اس کا (اخیافی) بھائی ہو حضرت علی اور زید (رض) کے قول کے مطابق خاوند کے لیے نصف اور اخیافی بھائی کے لیے سدس ہے اور وہ دونوں باقی میں شریک ہوں گے اور عبداللہ (رض) کے قول میں خاوند کے لیے نصف اور باقی سارا اخیافی بھائی کے لیے ہے۔
12379 Shobay se riwayat hai ke jo aurat chacha ke do bete chhore un mein se ek uska khawind ho aur dusra uska akhyafi bhai ho Hazrat Ali aur Zaid (Raz) ke qaul ke mutabik khawind ke liye nisf aur akhyafi bhai ke liye suds hai aur wo donon baqi mein sharik honge aur Abdullah (Raz) ke qaul mein khawind ke liye nisf aur baqi sara akhyafi bhai ke liye hai.
