باب لا يفرض واجبا إلا لبالغ يطيق مثله القتال

Sunan al-Kubra Bayhaqi 13004

Narrated Ibn 'Umar (RA): On the day of Uhud, the Messenger of Allah (peace be upon him) called me to fight. I said: "I am fourteen years old." So he did not permit me. Then on the day of Khandaq (the Trench), he called me, and I said: "I am fifteen years old." He (peace be upon him) permitted me. Nafi' said: I came to 'Umar bin 'Abdul-'Aziz, when he was the Caliph, and I mentioned this Hadith to him. He said: "This is the dividing line between the young and the old." Then he wrote to his officials that they should fix the stipend for the one who was fifteen years old, and whoever was below that should be returned to his family.

(١٣٠٠٤) ابن عمر (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے احد کے دن اس کو لڑنے کے لیے بلایا۔ ابن عمر (رض) نے فرمایا : میں چودہ برس کا ہوں، پس آپ نے مجھے اجازت نہ دی، پھر خندق کے دن بلایا میں نے کہا : میں پندرہ برس کا ہوں، آپ (صلی اللہ علیہ وآلہ وسلم) نے مجھے اجازت دے دی۔ نافع کہتے ہیں : میں عمر بن عبدالعزیز کے پاس آیا، جب وہ خلیفہ تھے، میں نے یہ حدیث بیان کی۔ انھوں نے کہا : یہ چھوٹے اور بڑے کے درمیان حد ہے، پھر اپنے عاملوں کو لکھا کہ اس کے لیے حصہ مقرر کرو جو پندرہ برس کا ہے اور جو اس کے علاوہ ہو اسے گھر والوں سے ملا دو ۔

(13004) Ibn Umar (RA) se riwayat hai ki Rasul Allah ((صلى الله عليه وآله وسلم)) ne Uhud ke din usko larne ke liye bulaya. Ibn Umar (RA) ne farmaya: Main chaudah baras ka hun, pas aap ne mujhe ijazat na di, phir Khandaq ke din bulaya maine kaha: Main pandrah baras ka hun, aap ((صلى الله عليه وآله وسلم)) ne mujhe ijazat de di. Nafi kahte hain: Main Umar bin Abdulaziz ke pass aaya, jab wo khalifa the, maine ye hadees bayan ki. Unhon ne kaha: Ye chhote aur bade ke darmiyan had hai, phir apne amlon ko likha ki iske liye hissa muqarar karo jo pandrah baras ka hai aur jo uske ilawa ho use ghar walon se mila do.

١٣٠٠٤ - أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللهِ الْحَافِظُ، أَخْبَرَنِي أَبُو أَحْمَدَ الْحَافِظُ، أنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ الْحُسَيْنِ الْخَثْعَمِيُّ، ثنا عُبَيْدُ بْنُ إِسْمَاعِيلَ، ثنا أَبُو أُسَامَةَ،عَنْ عُبَيْدِ اللهِ قَالَ:حَدَّثَنِي نَافِعٌ،قَالَ:حَدَّثَنِي ابْنُ عُمَرَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ" عَرَضَهُ يَوْمَ أُحُدٍ لِلْقِتَالِ،قَالَ:وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةً، فَلَمْ يُجِزْنِي،قَالَ:ثُمَّ عَرَضَنِي يَوْمَ الْخَنْدَقِ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً، فَأَجَازَنِي "قَالَ نَافِعٌ: فَقَدِمْتُ عَلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَهُوَ إِذْ ذَاكَ خَلِيفَةٌ، فَحَدَّثْتُ هَذَا الْحَدِيثَ،فَقَالَ:إِنَّ هَذَا الْحَدَّ بَيْنَ الصَّغِيرِ وَالْكَبِيرِ. ثُمَّ كَتَبَ إِلَى عُمَّالِهِ بِأَنْ يَفْرِضُوا لِمَنْ بَلَغَ خَمْسَ عَشْرَةَ سَنَةً، وَمَا كَانَ دُونَ ذَلِكَ أَنْ يَجْعَلُوهُ مَعَ الْعِيَالِ. رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عُبَيْدٍ، وَأَخْرَجَهُ مُسْلِمٌ مِنْ أَوْجُهٍ أُخَرَ عَنْ عُبَيْدِ اللهِ بْنِ عُمَرَ

Zaid bin Aslam narrated from his father that Umar (may Allah be pleased with him) said, "Gather this Fay' (spoils of war) so we can estimate it." Then later he said, "I ordered you to gather it so we could estimate it, but I have read in the Book of Allah, and I am free from it." Allah says: "Whatsoever Allah has bestowed upon His Messenger as spoils from the people of the townships, it is for Allah and for the Messenger" until His saying "Severe in punishment." By Allah! It is not for these alone. Then he recited, "And for the poor emigrants who were expelled from their homes and their properties," then he recited, "And those who came after them, saying, 'Our Lord, forgive us and our brothers who preceded us in faith." By Allah! It is not for them either. And if it remains next year, I will surely distribute it. I will make the last ones like the first ones, I swear by that. While they were distributing, his son came. Abdur Rahman bin Lahiyya, who was from one of Umar's wives, said, "Give me a signet ring." Umar said to him, "Go to your mother, she will give you some stew. By Allah! He did not give him anything.

(١٣٠٠٥) زید بن اسلم اپنے والد سے نقل فرماتے ہیں کہ حضرت عمر (رض) نے کہا : اس مال فئی کو جمع کرو تاکہ ہم اندازہ لگائیں۔ پھر بعد میں یہی کہا کہ میں نے تم کو حکم دیا ہے، اسے جمع کرو تاکہ ہم اندازہ لگائیں اور میں نے اللہ کی کتاب میں پڑھا ہے، میں ان سے بے پروا ہوں۔ اللہ فرماتے ہیں : { مَا أَفَائَ اللَّہُ عَلَی رَسُولِہِ مِنْ أَہْلِ الْقُرَی فَلِلَّہِ وَلِلرَّسُولِ } إِلَی قَوْلِہِ { شَدِیدُ الْعِقَابِ } اللہ کی قسم یہ ان اکیلوں کے لیے نہیں ہے پھر پڑھا { لِلْفُقَرَائِ الْمُہَاجِرِینَ الَّذِینَ أُخْرِجُوا مِنْ دِیَارِہِمْ وَأَمْوَالِہِمْ } پھر پڑھا : { وَالَّذِینَ جَائُ وا مِنْ بَعْدِہِمْ یَقُولُونَ رَبَّنَا اغْفِرْ لَنَا وَلإِخْوَانِنَا الَّذِینَ سَبَقُونَا بِالإِیمَانِ } اللہ کی قسم ! ان کے لیے بھی نہیں اور اگر آئندہ سال میں باقی رہا تو میں ضرور ملاؤں گا آخری لوگوں کو بھی پہلوں سے پس میں ضرور ان کو ایک ہی قسم بناؤں گا۔ جب وہ تقسیم کر رہے تھے تو ان کا بیٹا آیا۔ عبدالرحمن بن لہیہ جو عمر کی ایک بیوی سے تھا اس نے کہا : مجھے انگوٹھی پہناؤ۔ عمر (رض) نے اسے کہا : اپنی ماں سے کہو، وہ تجھے ستو پلائے، اللہ کی قسم ! اسے کوئی چیز نہ دی۔

(13005) Zaid bin Aslam apne walid se naql farmate hain ki Hazrat Umar (Razi Allahu Anhu) ne kaha: Is mal fai ko jama karo taake hum andaza lagaen. Phir baad mein yahi kaha ki maine tum ko hukm diya hai, ise jama karo taake hum andaza lagaen aur maine Allah ki kitaab mein parha hai, mein in se be parwah hun. Allah farmate hain: {Maa Afa' Allah 'Ala Rasulihi Min Ahli Al-Qaryi Falil-lahi Wa Lil-Rasul} Ilaa Qawlihi {Shadidul-'Iqab} Allah ki qasam yeh in akelon ke liye nahin hai phir parha {Lil-Fuqara' Al-Muhajireena Al-Ladhina 'Ukhriju Min Diyarihim Wa-'Amwalihim} phir parha: {Wa Al-Ladhina Ja'u Min Ba'dihim Yaquluna Rabbana 'Ughfir Lana Wa Li-'Ikhwanina Al-Ladhina Sabaquna Bil-'Iman} Allah ki qasam! In ke liye bhi nahin aur agar aayinda saal mein baqi raha to mein zaroor milaunga aakhri logon ko bhi pehlon se pas mein zaroor in ko ek hi qisam banaonga. Jab woh taqsim kar rahe the to un ka beta aaya. Abdul Rahman bin Lahiya jo Umar ki ek biwi se tha usne kaha: Mujhe anguthi pehnao. Umar (Razi Allahu Anhu) ne usay kaha: Apni maan se kaho, woh tujhe sattu pilaye, Allah ki qasam! Use koi cheez na di.

١٣٠٠٥ - أَخْبَرَنَا أَبُو الْحُسَيْنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ، أنا إِسْمَاعِيلُ بْنُ مُحَمَّدٍ الصَّفَّارُ، ثنا سَعْدَانُ بْنُ نَصْرٍ، ثنا وَكِيعٌ، عَنْ هِشَامِ بْنِ سَعْدٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ،عَنْ أَبِيهِ قَالَ:قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ:" اجْتَمِعُوا لِهَذَا الْفَيْءِ حَتَّى نَنْظُرَ فِيهِ "،قَالَ:ثُمَّ قَالَ لَهُمْ بَعْدُ:" إِنِّي قَدْ كُنْتُ أَمَرْتُكُمْ أَنْ تَجْتَمِعُوا لَهُ حَتَّى نَنْظُرَ فِيهِ، وَإِنِي قَرَأْتُ آيَاتٍ مِنْ كِتَابِ اللهِ عَزَّ وَجَلَّ فَاسَتْغَنَيْتُ بِهِنَّ، قَالَ اللهُ عَزَّ وَجَلَّ{مَا أَفَاءَ اللهُ عَلَى رَسُولِهِ مِنْ أَهْلِ الْقُرَى فَلِلَّهِ وَلِلرَّسُولِ وَلِذِي الْقُرْبَى}[الحشر: ٧]إِلَى قَوْلِهِ{شَدِيدُ الْعِقَابِ}[الحشر: ٧]، وَاللهِ مَا هُوَ لِهَؤُلَاءِ وَحْدَهُمْ، ثُمَّ قَرَأَ{لِلْفُقَرَاءِ الْمُهَاجِرِينَ الَّذِينَ أُخْرِجُوا مِنْ دِيَارِهِمْ وَأَمْوَالِهِمْ}[الحشر: ٨]إِلَى آخِرِ الْآيَةِ، ثُمَّ قَرَأَ{وَالَّذِينَ جَاءُوا مِنْ بَعْدِهِمْ يَقُولُونَ رَبَّنَا اغْفِرْ لَنَا وَلِإِخْوَانِنَا الَّذِينَ سَبَقُونَا بِالْإِيمَانِ}، وَاللهِ مَا هُوَ لِهَؤُلَاءِ وَحْدَهُمْ، وَلَئِنْ بَقِيتُ إِلَى قَابِلٍ لَأُلْحِقَنَّ آخِرَ النَّاسِ بِأَوَّلِهِمْ، فَلَأَجْعَلَنَّهُمْ بَبَّانًا وَاحِدًا، يَعْنِي بَاجًا وَاحِدًا "،قَالَ:فَجَاءَ ابْنٌ لَهُ وَهُوَ يَقْسِمُ يُقَالُ لَهُ عَبْدُ الرَّحْمَنِ ابْنُ ⦗٥٧٤⦘ لُهَيَّةَ، امْرَأَةٌ كَانَتْ لِعُمَرَ رَضِيَ اللهُ عَنْهُ،فَقَالَ لَهُ:اكْسُنِي خَاتَمًا،فَقَالَ لَهُ:" الْحَقْ بِأُمِّكَ تَسْقِيكَ شَرْبَةً مِنْ سَوِيقٍ، فَوَاللهِ مَا أَعْطَاهُ شَيْئًا "
