Chapter on the marriage of a Kitabi (Jewish or Christian) slave woman to a Muslim is not valid conditionally
باب لا يحل نكاح أمة كتابية لمسلم بحال
Sunan al-Kubra Bayhaqi 14012
Mujaahid said that marriage with the slave women of the People of the Book is not permissible, because Allah says, "{مِنْ فَتَیٰتِکُمُ الْمُؤْمِنٰتِ} – from among your believing women slaves".

(١٤٠١٢) مجاہد فرماتے ہیں کہ اہل کتاب کی لونڈیوں سے نکاح درست نہیں؛ کیونکہ اللہ کا فرمان ہے : { مِنْ فَتَیٰتِکُمُ الْمُؤْمِنٰتِ } ” یعنی مومنہ لونڈیوں سے۔ “
(14012) Mujahid farmate hain keh ahl e kitab ki laundiyon se nikah durust nahi kyunki Allah ka farman hai { min fatayatikumul mominaat } yani momina laundiyon se
Regarding the statement of Hasan Allah: { وَمَن لَّمْ يَسْتَطِعْ مِنكُمْ طَوْلًا } [ النساء ٢٥] "And whoever among you cannot afford to marry free believing women" {مِن فَتَيَاتِكُمُ الْمُؤْمِنَاتِ}, he said that we are not allowed (to marry) the slave girls of the People of the Book.

(١٤٠١٣) حضرت حسن اللہ کے اس فرمان : { وَ مَنْ لَّمْ یَسْتَطِعْ مِنْکُمْ طَوْلًا } [النساء ٢٥] ” اور جو تم میں سے نکاح کی طاقت نہ رکھتا ہو۔ “ { مِنْ فَتَیٰتِکُمُ الْمُؤْمِنٰتِ } کے بارے میں فرماتے ہیں کہ ہمیں اہل کتاب کی لونڈیوں میں اجازت نہیں دی گئی۔
hazrat hasan allah ke is farmaan : { wa man lam yastati minkum tawlan } [alnesa 25] ” aur jo tum mein se nikah ki taqat na rakhta ho “ { min fataitikumul mominaati } ke bare mein farmate hain ke hamen ahl e kitab ki londion mein ijazat nahi di gai.
Jurists state that it is not permissible for a Muslim man to marry a Jewish or Christian slave woman. Marriage is only permitted with a free woman from the People of the Book, as a slave woman is not considered to be of chaste character. This has been narrated from Said ibn Musayyib, Urwah ibn Zubayr, Qasim ibn Muhammad, Abu Bakr ibn Abdur Rahman, Kharijah ibn Zayd, and Ubaydullah ibn Abdullah ibn Utbah.

(١٤٠١٤) فقہاء فرماتے ہیں کہ یہودی و عیسائی کی لونڈی سے مسلمان کے لیے نکاح جائز نہیں ہے، صرف اہل کتاب کی آزاد عورت سے نکاح جائز ہے اور لونڈی پاک دامن نہیں ہوتی۔ یہ سعید بن مسیب، عروہ بن زبیر، قاسم بن محمد، ابوبکر بن عبدالرحمن، خارجہ بن زید، عبیداللہ بن عبداللہ بن عتبہ سے بھی منقول ہے۔
(14014) Fuqaha farmate hain ke yahudi o eesai ki londi se musalman ke liye nikah jaiz nahi hai, sirf ahl e kitab ki azad aurat se nikah jaiz hai aur londi pak daaman nahi hoti. Ye Saeed bin Musib, Urwah bin Zubair, Qasim bin Muhammad, Abubakar bin Abdur Rahman, Kharija bin Zaid, Ubaidullah bin Abdullah bin Utbah se bhi manqol hai.
