باب نكاح أهل الشرك وطلاقهم
Sunan al-Kubra Bayhaqi 14075
Aisha (RA) narrates that there were four types of marriages in the pre-Islamic period: 1. One of them was that a man would send a proposal to the guardian of a woman, then after paying the dowry, he would marry her.
Imam Shafi'i (RA) states that the Messenger of Allah (peace and blessings of Allah be upon him) had an adulterous Jewish couple stoned to death, then married them after the punishment, so why would marriage not be permissible after they have become پاک دامن (pure)?

(١٤٠٧٥) حضرت عائشہ (رض) فرماتی ہیں کہ جاہلیت کے نکاح چار طرح سے ہوتے تھے : 1 ان میں سے ایک تو یہ ہے کہ کوئی شخص کسی عورت کے ولی کو نکاح کا پیغام دیتا ہے، پھر وہ حق مہر ادا کر کے نکاح کرلیتا ہے۔
امام شافعی (رح) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے یہودی زانی جوڑے کو رجم کیا، ان کے بعد ان کی شادی کردی تو جب وہ پاک دامن ہو تب شادی کیوں جائز نہیں ہے۔
(14075) hazrat ayesha (rz) farmati hain ke jahiliyat ke nikah chaar tarah se hote thay : 1 in mein se aik to ye hai ke koi shakhs kisi aurat ke wali ko nikah ka paigham deta hai, phir wo haq mehr ada kar ke nikah karleta hai.
imam shafi (rh) farmate hain ke rasool allah ((صلى الله عليه وآله وسلم)) ne yahoodi zani jore ko rajm kiya, un ke baad un ki shadi kardi to jab wo pak daaman ho tab shadi kyun jaiz nahi hai.
Abdullah ibn Abbas (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said, "No children were born to me out of fornication during the pre-Islamic period (Jahiliyyah) as many as the children born to me out of marriage, like the marriage of Islam."

(١٤٠٧٦) حضرت عبداللہ بن عباس (رض) فرماتے ہیں کہ رسول کریم (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جاہلیت کے زنا سے مجھے اتنے بچے میسر نہیں آئے جتنے بچے نکاح سے حاصل ہوئے ہیں، جیسے اسلام کا نکاح ہے۔
(14076) Hazrat Abdullah bin Abbas (RA) farmate hain keh Rasul Kareem (SAW) ne farmaya : jahiliyat ke zina se mujhe itne bache mayassar nahi aaye jitne bache nikah se hasil hue hain, jaise Islam ka nikah hai.
Ja'far ibn Muhammad reported from his father concerning Allah's saying: {There has certainly come to you a Messenger from among yourselves. Grievous to him is what you suffer; [he is] concerned over you}, [At-Tawbah: 128] “There has certainly come to you a Messenger from among yourselves. It grieves him that you should suffer; [he is] very eager for your [guidance].” He said that nothing came from the time of ignorance and the Prophet (peace and blessings of Allah be upon him) said that my birth was from marriage, not from fornication.

(١٤٠٧٧) جعفر بن محمد اپنے والد سے اللہ تعالیٰ کے اس فرمان : { لَقَدْ جَآئَ کُمْ رَسُوْلٌ مِّنْ اَنْفُسِکُمْ عَزِیْزٌ عَلَیْہِ مَا عَنِتُّمْ حَرِیْصٌ عَلَیْکُمْ } [التوبۃ ١٢٨] ” تمہارے پاس تمہارے ہی نفسوں سے رسول آئے ان پر شاق ہے کہ تم مشقت میں پڑو، تم پر بہت زیادہ حریص ہیں۔ “ کہتے ہیں کہ جاہلیت کی پیدائش سے کوئی چیز حاصل نہیں ہوئی اور نبی (صلی اللہ علیہ وآلہ وسلم) نے فرمایا کہ میری پیدائش نکاح سے ہوئی زنا سے نہیں۔
Jafar bin Muhammad apne walid se Allah ta'ala ke is farmaan: {laqad jaakum rasoolum min anfusikum azeezun alaihi ma 'anittum hareesun 'alaikum} [al-tawbah 128] "Tumhare pass tumhare hi nufus se rasool aae un par shaq hai ki tum mushqil mein paro, tum par bahut zyada haris hain." kahte hain ki jahiliyat ki paidaish se koi cheez hasil nahi hui aur Nabi ((صلى الله عليه وآله وسلم)) ne farmaya ki meri paidaish nikah se hui zina se nahi.
Anas (may Allah be pleased with him) narrated that a man said: "O Messenger of Allah! Where is my father?" He said: "In the Fire." When he turned to leave, the Prophet (peace and blessings of Allah be upon him) said: "My father and your father are in Hellfire."

(١٤٠٧٨) حضرت انس (رض) فرماتے ہیں کہ ایک شخص نے کہا : اے اللہ کے رسول ! میرا باپ کہاں ہے ؟ فرمایا : آگ میں، جب وہ جانے لگا تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میرا اور تیرا باپ جہنم میں ہیں۔ “
(14078) Hazrat Anas (RA) farmate hain keh aik shakhs ne kaha: Aye Allah ke Rasool! Mera baap kahan hai? Farmaya: Aag mein, jab woh jane laga to aap ((صلى الله عليه وآله وسلم)) ne farmaya: Mera aur tera baap jahannum mein hain.
Abu Hurairah (may Allah be pleased with him) reported: The Messenger of Allah (peace and blessings be upon him) said: I sought permission (from my Lord) to pray for the forgiveness of my mother, but it was not granted. Then I sought permission to visit her grave and it was granted.

(١٤٠٧٩) حضرت ابوہریرہ (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : میں نے اپنی والدہ کی بخشش کے لیے دعا کی اجازت طلب کی، لیکن اجازت نہ ملی، پھر قبر کی زیارت کی اجازت دے دی گئی۔
(14079) Hazrat Abu Huraira (RA) farmate hain keh Rasul Allah (SAW) ne farmaya: main ne apni walida ki bakhshish ke liye dua ki ijazat talab ki, lekin ijazat na mili, phir qabar ki ziarat ki ijazat de di gai.
