Ali (may Allah be pleased with him) states regarding a woman whose husband is missing, that when he returns and the woman has remarried, then it is his choice whether to divorce her or keep her, and the woman will not be given a choice.

(١٥٥٦٢) حضرت علی (رض) اس عورت کے متعلق فرماتے ہیں جس کا خاوند گم ہوجائے کہ جب وہ آئے اور عورت نے شادی کرلی ہو تو اگر چاہے تو اسے طلاق دے دے اور اگر چاہے تو روک اور عورت کو اختیار نہیں دیا جائے گا۔
(15562) Hazrat Ali (RA) is aurat ke mutalliq farmate hain jis ka khaavand gum hojaye keh jab wo aaye aur aurat ne shadi karli ho to agar chahe to use talaq de de aur agar chahe to rok aur aurat ko ikhtiyar nahi diya jaye ga.
It has been narrated on the authority of Hanash that `Ali (may Allah be pleased with him) said: What 'Umar (may Allah be pleased with him) said is nothing, i.e. about the wife of a missing husband, she is the wife of the one who is missing until certain news comes of his death or certain news of his divorce and she is entitled to a dower from him because of his having made lawful her private parts and his marriage is void.
And it has been narrated to us on the authority of Sa`id ibn Jubair from `Ali, that `Ali (may Allah be pleased with him) said: She is the wife of the first husband whether the second has had intercourse with her or not.

(١٥٥٦٣) حنش سے روایت ہے کہ علی (رض) نے فرمایا : وہ بات جو عمر (رض) نے کہی ہے، کچھ بھی نہیں ہے یعنی گم شدہ خاوند کی بیوی کے بارے میں یہ اسی کی بیوی ہے جو غائب ہوگیا ہے۔ یہاں تک کہ اس کی موت کی یقینی خبر آجائے یا اس کی طلاق کی یقینی خبر آجائے اور اس کے لیے حق مہر ہوگا اس مرد سے اس کی شرمگاہ کو حلال کیے جانے کی وجہ سے اور اس کا نکاح باطل ہے۔
اور ہم کو سعید بن جُبیر عن علی سے روایت بیان کی گئی کہ علی (رض) نے فرمایا : یہ پہلے خاوند کی بیوی ہے اس کے ساتھ دوسرے نے دخول کیا ہو یا نہ کیا ہو۔
(15563) Hanash se riwayat hai ki Ali (RA) ne farmaya: Woh baat jo Umar (RA) ne kahi hai, kuchh bhi nahin hai yani gum shuda khaawand ki biwi ke bare mein yeh usi ki biwi hai jo ghaib hogaya hai. Yahan tak ki uski maut ki yaqeeni khabar aajae ya uski talaq ki yaqeeni khabar aajae aur uske liye haq mehr hoga us mard se uski sharamgah ko halal kiye jaane ki wajah se aur uska nikah batil hai.
Aur hum ko Saeed bin Jubair an Ali se riwayat bayan ki gayi ki Ali (RA) ne farmaya: Yeh pehle khaawand ki biwi hai uske saath dusre ne dakhil kiya ho ya na kiya ho.
(15564) It is narrated from Ibn Shibrma that Umar bin Abdul Aziz wrote regarding the wife of a missing husband that she should blame herself and be patient.

(١٥٥٦٤) ابن شبرمہ سے روایت ہے کہ عمر بن عبدالعزیز نے گم شدہ خاوند کی بیوی کے بارے میں لکھا کہ وہ اپنے آپ کو ملامت کرے اور صبر کرے۔
(15564) Ibne Shibrama se riwayat hai ki Umar bin Abd-al-Aziz ne gum shuda khawanad ki biwi ke bare mein likha ki wo apne aap ko malamat kare aur sabar kare.
(15565) It is narrated on the authority of Mughirah ibn Shu'bah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "A woman whose husband is missing remains his wife until there is clarification regarding him."
And similarly, Zakaria ibn Yahya al-Wasiti narrated it from Suwar ibn Mus'ab, and Suwar is a weak narrator.

(١٥٥٦٥) مغیرہ بن شعبہ (رض) سے روایت ہے کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : وہ عورت جس کا خاوند گم ہوجائے وہ اسی کی بیوی ہے حتیٰ کہ اس کے بارے میں وضاحت آجائے۔
اور اسی طرح زکریا بن یحییٰ واسطی نے سوار بن مصعب سے بیان کیا ہے اور سوار ضعیف راوی ہے۔
Mughirah bin Shubah (RA) se riwayat hai ki Rasul Allah (SAW) ne farmaya: Woh aurat jis ka khawanad gum ho jaye woh usi ki biwi hai hatta ki uske bare mein wazahat aajaye. Aur isi tarah Zakaria bin Yahya Wasti ne Suwar bin Musab se bayan kya hai aur Suwar zaeef rawi hai.
