(15757) It is narrated on the authority of Abu Huraira (may Allah be pleased with him) that the Prophet (peace and blessings of Allah be upon him) gave a young boy the choice between his mother and his father.

(١٥٧٥٧) ابوہریرہ (رض) سے روایت ہے کہ نبی (صلی اللہ علیہ وآلہ وسلم) نے ایک لڑکے کو اس کی والدہ اور والد کے درمیان اختیار دیا۔
(15757) abu hurairah (rz) se riwayat hai keh nabi ((صلى الله عليه وآله وسلم)) ne ek larkay ko us ki walida aur walid ke darmiyan ikhtiyar diya.
Ibn Juraij said that Hilal bin Usama narrated to me that Abu Maimun Salim, a freed slave of the people of Medina and a truthful man, said: I was sitting with Abu Hurairah (may Allah be pleased with him) when a Persian woman came with her son. She was divorced. She said in Persian, “O Abu Hurairah! My husband wants to take my son away from me.” So Abu Hurairah said, “Draw lots.” In the meantime, her husband came and said, “Who wants to stop me from taking my son?” So Abu Hurairah said, “I did not say this on my own, but I was sitting with the Prophet (peace and blessings of Allah be upon him) when a woman came and said, ‘O Messenger of Allah! My husband wants to take my son back from me, and he has benefited me.’ So you gave the verdict of drawing lots between them.” The father said, “Who will stop me from taking my son?” So you addressed the child and said, “This is your father and this is your mother. Go with whomever you want.” So the child took his mother's hand and went with her.
These are the words of Razbari, and the words of Ibn Bashran's narration are fewer, but the meaning is the same.

(١٥٧٥٨) ابن جریج فرماتے ہیں کہ مجھے ہلال بن اسامہ نے بیان کیا کہ ابو میمونہ سلیم جو اہل مدینہ کے مولیٰ ہیں اور ایک سچے انسان ہیں، فرماتے ہیں : میں ابوہریرہ (رض) کے پاس بیٹھا ہوا تھا کہ ایک فارسی عورت آئی۔ اس کے ساتھ اس کا بیٹا بھی تھا اور وہ مطلقہ تھی ۔ وہ فارسی زبان میں کہنے لگی : اے ابوہریرہ (رض) ! میرا خاوند مجھ سے میرا بچہ چھیننا چاہتا ہے تو ابوہریرہ (رض) فرمانے لگے : قرعہ اندازی کرلو۔ اتنے میں اس کا خاوند بھی آگیا اور کہنے لگا : کون میرے بچے کو روکنا چاہتا ہے ؟ تو ابوہریرہ (رض) فرمانے لگے : یہ بات میں نے اپنی طرف سے نہیں کی بلکہ میں نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس بیٹھا ہوا تھا کہ ایک عورت آئی اور کہنے لگی : یا رسول اللہ (صلی اللہ علیہ وآلہ وسلم) ! میرا خاوند مجھ سے میرا بچہ واپس لینا چاہتا ہے، اس نے مجھے نفع بھی پہنچایا ہے تو آپ نے ان کے درمیان قرعہ کا فیصلہ فرمایا تو اس کا والد کہنے لگا : میرے بچے کو کون روکے گا ؟ تو آپ نے بچے کو مخاطب کر کے فرمایا : یہ تیرا باپ ہے اور یہ تیری ماں، جس کے ساتھ مرضی چلا جا تو بچے نے ماں کا ہاتھ تھام لیا اور وہ اسے لے گئی۔
یہ روذ باری کے الفاظ ہیں اور جو ابن بشران کی حدیث ہے اس کے الفاظ کم ہیں لیکن معنیٰ یہی ہے۔
(15758) Ibn Juraij farmate hain ke mujhe Hilal bin Usama ne bayan kya ke Abu Maimoona Saleem jo ahl Madina ke mola hain aur ek sache insan hain, farmate hain : main Abu Hurairah (RA) ke paas baitha hua tha ke ek Farsi aurat aayi. Uske sath uska beta bhi tha aur wo mutlaqqa thi . Wo Farsi zaban mein kehne lagi : aye Abu Hurairah (RA) ! Mera khaawand mujhse mera bachcha chhenna chahta hai to Abu Hurairah (RA) farmane lage : qur'a andazi karlo. Itne mein uska khaawand bhi aagya aur kehne laga : kaun mere bachche ko rokna chahta hai ? To Abu Hurairah (RA) farmane lage : yeh baat maine apni taraf se nahi ki balke main Nabi ((صلى الله عليه وآله وسلم)) ke paas baitha hua tha ke ek aurat aayi aur kehne lagi : ya Rasulullah ((صلى الله عليه وآله وسلم)) ! Mera khaawand mujhse mera bachcha wapas lena chahta hai, usne mujhe nafa bhi pahunchaya hai to aap ne unke darmiyaan qur'a ka faisla farmaya to uska walid kehne laga : mere bachche ko kaun rokega ? To aap ne bachche ko mukhatib kar ke farmaya : yeh tera baap hai aur yeh teri maan, jis ke sath marzi chala ja to bachche ne maan ka hath thaam liya aur wo use le gayi.
Yeh roz baari ke alfaz hain aur jo Ibn Abi Shayban ki hadees hai uske alfaz kam hain lekin ma'ana yahi hai.
Abu Huraira (may Allah be pleased with him) reported that a woman came to the Prophet (peace and blessings of Allah be upon him) who was divorced, and her husband wanted to take the child from her. He said: "Cast lots." Her husband said: "Who would want to come between me and my child?" So the Prophet (peace and blessings of Allah be upon him) gave the child the choice, and he went with his mother.

(١٥٧٥٩) ابوہریرہ (رض) سے روایت ہے کہ ایک عورت نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس تشریف لائی جو مطلقہ تھی اور اس کا خاوند اس سے بچہ لینا چاہتا تھا۔ آپ نے فرمایا : قرعہ ڈال لو تو اس کا خاوند کہنے لگا : میرے اور میرے بچے کے درمیان کون حائل ہونا چاہتا ہے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے بچے کو اختیار دیا تو وہ ماں کے ساتھ چلا گیا۔
(15759) Abu Huraira (RA) se riwayat hai ki aik aurat Nabi (SAW) ke paas tashreef laayi jo mutallaqa thi aur uska khaawand us se bachcha lena chahta tha. Aap ne farmaya: Qura daal lo. To uska khaawand kehne laga: Mere aur mere bachche ke darmiyaan kaun hail hona chahta hai? To aap (SAW) ne bachche ko ikhtiyar diya to woh maan ke saath chala gaya.
Rafi' bin Sinan narrates that when he embraced Islam, his wife refused to accept Islam. His wife came to the Prophet (peace and blessings of Allah be upon him) and said: "This is my child who has just completed the breastfeeding period," and Rafi' said: "This is my child." So you (peace and blessings of Allah be upon him) made Rafi' (may Allah be pleased with him) sit on one side and his wife on the other side and placed the child in the middle. And he said: "Now call him to your side." So the child went towards his mother. Then the Prophet (peace and blessings of Allah be upon him) prayed: "O Allah! Guide him." So he went towards his father and Rafi' took him.
Rafi' bin Sinan is the grandfather of Abdul Hameed bin Ja'far.

(١٥٧٦٠) رافع بن سنان فرماتے ہیں کہ جب یہ مسلمان ہوگئے تو ان کی بیوی نے اسلام قبول کرنے سے انکار کردیا۔ ان کی بیوی نبی (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور کہنے لگی : یہ میرا بچہ جس کی مدت رضاعت ابھی پوری ہوئی ہے اور رافع کہنے لگے : یہ میرا بچہ ہے تو آپ (صلی اللہ علیہ وآلہ وسلم) نے ایک طرف رافع (رض) کو بٹھایا اور دوسری طرف ان کی بیوی کو اور بچے کو درمیان میں بٹھا دیا اور فرمایا : اب اسے اپنی طرف بلاؤ تو بچہ ماں کی طرف جانے لگا تو نبی (صلی اللہ علیہ وآلہ وسلم) نے دعا کی : ” اے اللہ ! اسے ہدایت دے “ تو وہ باپ کی طرف چلا گیا اور رافع اسے لے گئے۔

15760 Rafi bin Sinan farmate hain ki jab ye musalman ho gaye to un ki biwi ne Islam qubool karne se inkar kar diya Un ki biwi Nabi ((صلى الله عليه وآله وسلم)) ke pas aai aur kahne lagi ye mera bachcha jis ki muddat riwayat abhi poori hui hai aur Rafi kahne lage ye mera bachcha hai to aap ((صلى الله عليه وآله وسلم)) ne ek taraf Rafi (Razi) ko bithaya aur dusri taraf un ki biwi ko aur bachche ko darmiyan mein bitha diya aur farmaya ab ise apni taraf bulao to bachcha maan ki taraf jane laga to Nabi ((صلى الله عليه وآله وسلم)) ne dua ki aye Allah ise hidayat de to woh baap ki taraf chala gaya aur Rafi use le gaye

Ammarah Jarmi says that Ali (may Allah be pleased with him) gave me the choice between my mother and my uncle and then he said about my younger brother that if he was of such age, I would have given him the choice as well.

(١٥٧٦١) عمارۃ جرمی فرماتے ہیں کہ مجھے میری والدہ اور چچا کے درمیان حضرت علی (رض) نے اختیار دیا تھا اور پھر میرے چھوٹے بھائی کے بارے میں فرمایا تھا کہ اگر اس کی بھی عمر ایسی ہوتی تو میں اسے بھی اختیار دیتا۔
(15761) Umarah Jarmi farmate hain ki mujhe meri walida aur chacha ke darmiyan Hazrat Ali (RA) ne ikhtiyar diya tha aur phir mere chhote bhai ke bare mein farmaya tha ki agar uski bhi umar aisi hoti to main use bhi ikhtiyar deta.
Imam Shafi'i (may God have mercy on him) said: Ibrahim narrated that Yunus narrated from Amr, and he narrated from Ali (may God be pleased with him) in a similar manner, and also said that I was seven or eight years old at that time. Umar ibn al-Khattab (may God be pleased with him) also gave a child the choice of choosing whichever parent he wanted.

(١٥٧٦٢) امامشافعی (رح) فرماتے ہیں : ابراہیم نے فرمایا کہ یونس نے عمارہ سے اور وہ حضرت علی سے اسی طرح روایت کرتے ہیں اور ساتھ یہ بھی فرمایا کہ اس وقت میں سات یا آٹھ برس کا تھا۔ حضرت عمر بن خطاب (رض) نے بھی ایک بچے کو اختیار دیا تھا کہ وہ ماں یا باپ میں سے جس کو مرضی چن لے۔
(15762) Imamshafai (rh) farmate hain : Ibrahim ne farmaya keh Younas ne Ammarah se aur wo Hazrat Ali se isi tarah riwayat karte hain aur sath ye bhi farmaya keh us waqt mein sat ya aath bars ka tha. Hazrat Umar bin Khattab (rz) ne bhi ek bache ko ikhtiyar diya tha keh wo maa ya baap mein se jis ko marzi chun le.
