Chapter: The repentance of one who fought against Muslims

Sunan al-Kubra Bayhaqi 17319
Said ibn Jubayr said that whoever commits robbery is a combatant. He also said, “If he has merely killed (someone), then he should be killed. If, along with killing, he has also plundered wealth, then he should be killed and then crucified. If he has merely plundered wealth and has not killed, then his hands and feet should be cut off. If he repents, then it is between him and Allah; the prescribed punishment (had) shall be established (i.e. carried out).”

(١٧٣١٩) سعید بن جبیر فرماتے ہیں کہ جو ڈاکہ زنی کرے وہی جنگ کرنے والا ہے اور کہتے ہیں کہ اگر صرف قتل کیا ہے تو اسے بھی قتل کیا جائے۔ اگر قتل کے ساتھ مال بھی لوٹا ہے تو اسے قتل اور پھر سولی پر لٹکایا جائے ۔ اگر صرف مال لوٹا ہے قتل نہیں کیا تو اس کے ہاتھ پاؤں کاٹے جائیں۔ اگر توبہ کرلے تو یہ اس کے اور اللہ کے درمیان ہے حد قائم کی جائے گی۔
Saeed bin Jubair farmate hain keh jo daka zani kare wohi jang karne wala hai aur kehte hain keh agar sirf qatal kiya hai to usay bhi qatal kiya jaye. Agar qatal ke sath maal bhi loota hai to usay qatal aur phir sooli par latkaya jaye. Agar sirf maal loota hai qatal nahin kiya to us ke hath paon kaate jayen. Agar toba karle to yeh us ke aur Allah ke darmiyaan hai had qaim ki jaye gi.
Hisham narrates from his father that if someone commits a punishable offense and then repents, the prescribed punishment will still be carried out on him.

(١٧٣٢٠) ہشام اپنے والد سے نقل فرماتے ہیں کہ جو حد کو پہنچ جائے اور توبہ کرلے تو بھی اس پر حد قائم کی جائے گی۔
Hisham apne walid se naql farmate hain ke jo had ko phonch jaye aur toba karle to bhi us par had qaim ki jaye gi.
Ibrahim says that whoever commits robbery and plunder, the prescribed punishment will be established upon him despite his repentance. The rest is between Allah and him.

(١٧٣٢١) ابراہیم کہتے ہیں کہ جو ڈاکہ زنی کرے اور غارت گری کرے تو اس پر توبہ کے باوجود حد قائم کی جائے گی باقی اللہ اور اس کا معاملہ ہے۔
(17321) Ibrahim kehte hain keh jo daka zani kare aur gharat gari kare to is par toba ke bawajood had qaim ki jaye gi baqi Allah aur is ka mamla hai.
(17322) A man came to Abu Musa Ash'ari after the Fajr prayer and said: I was a robber before you caught me. I have already repented to Allah. So Abu Musa said: Indeed, you came first, and He has dealt with you with goodness.

(١٧٣٢٢) ابو موسیٰ اشعری کے پاس فجر کی نماز کے بعد ایک شخص آیا اور کہنے لگا : میں ڈاکو تھا قبل اس کے کہ آپ مجھے پکڑیں میں خود اللہ سے توبہ کرچکا ہوں تو ابو موسیٰ نے کہا : واقعی تو پہلے آگیا ہے اور اس کے ساتھ بھلائی کا معاملہ فرمایا۔
Abu Musa Ashari ke pas fajr ki namaz ke bad ek shakhs aaya aur kahne laga : mein daku tha qabal is ke keh aap mujhe pakrein mein khud Allah se tauba karchuka hun to Abu Musa ne kaha : waqai to pehle aagaya hai aur is ke sath bhalaai ka mamla farmaaya.
