Chapter: The drinker receives additional punishment beyond forty lashes and dies from the excess; one who dies without a prescribed punishment is punished accordingly
باب الشارب يضرب زيادة على الأربعين فيموت في الزيادة، والذي يموت في غير حد واجب فيما يعاقب به
Sunan al-Kubra Bayhaqi 17549
Ali said, "If I give punishment to a person and he dies, I find it in myself (meaning, I feel a sense of responsibility or guilt). But if a drunkard dies due to alcohol, I would pay his blood money because the Prophet (peace be upon him) has not set any limit for it."
Sufyan says, "Allah knows best, its meaning could be that he (the Prophet) did not prescribe anything more than 40 lashes or hitting with shoes and hands."

(١٧٥٤٩) حضرت علی فرماتے ہیں کہ جس آدمی پر بھی میں حد نافذ کروں اور وہ مرجائے تو میں اپنے نفس میں پاتا ہوں مگر شراب کے اگر شرابی مرجاتا ہے تو میں اس کی دیت دوں گا، کیونکہ نبی (صلی اللہ علیہ وآلہ وسلم) نے اس کے بارے میں کوئی حد مقرر نہیں فرمائی۔
سفیان کہتے ہیں کہ واللہ اعلم اس کا یہ مطلب ہوسکتا ہے کہ ٤٠ کوڑوں یا جوتیوں اور ہاتھوں سے مارنے سے زائد کچھ مقرر نہیں فرمایا۔
(17549) Hazrat Ali farmate hain keh jis aadmi par bhi main had nafiz karoon aur wo mar jaye to main apne nafs mein pata hun magar sharaab ke agar sharaabi mar jata hai to main uski deet doon ga, kyunkeh Nabi ((صلى الله عليه وآله وسلم)) ne uske bare mein koi had muqarrar nahin farmai.
Sufyan kehte hain keh Wallahu Alim iska yeh matlab ho sakta hai keh 40 kodon ya jootion aur hathon se marne se zaid kuch muqarrar nahin farmaya.
Ali said that from among the limits, the one about which I feel sad is the one related to alcohol. Whoever dies because of it, I will pay his blood money from Baitul Maal, or the narrator is doubtful, (he may have said) on behalf of the Imam. Imam Shafi'i (may Allah have mercy on him) said that it has reached us that Umar sent a message to a woman, and she was startled and miscarried. Then, Umar (may Allah be pleased with him) consulted with Ali (may Allah be pleased with him), so you advised to give the blood money. So, Umar said that I have decided that I will divide it among your nation.

(١٧٥٥٠) حضرت علی فرماتے ہیں کہ حدود میں سے جو حد خمر میں مرجائے، اس کا مجھے افسوس ہوتا ہے۔ جو اس سے مرجائے میں اس کی دیت بیت المال سے دوں گا یا راوی کو شک ہے کہ امام کی طرف سے، امام شافعی (رح) فرماتے ہیں کہ ہمیں یہ بات پہنچی ہے کہ حضرت عمر نے ایک عورت کی طرف پیغام بھیجا، وہ گھبرا گئی اور اس کا حمل ساقط ہوگیا تو علی (رض) سے عمر (رض) نے مشورہ مانگا تو آپ نے دیت کا مشورہ دیا تو حضرت عمر نے فرمایا کہ میں نے یہ عزم کیا کہ اسے تیری قوم پر تقسیم کروں۔
(17550) Hazrat Ali farmate hain keh hudood mein se jo had khamr mein marjae, us ka mujhe afsos hota hai. Jo us se marjae mein us ki deyat bait ul mal se dun ga ya ravi ko shak hai keh imam ki taraf se, Imam Shafai (rah) farmate hain keh humain yeh baat pahunchi hai keh Hazrat Umar ne ek aurat ki taraf paigham bheja, woh ghabra gayi aur us ka hamal saqit ho gaya to Ali (ra) se Umar (ra) ne mashwara manga to aap ne deyat ka mashwara diya to Hazrat Umar ne farmaya keh mein ne yeh azm kiya keh use tumhari qaum par taqseem karoon.
Abdullah bin Mughaffal narrated that Ali ordered a man to be given lashes. The executioner lashed him two more times than the prescribed amount, so Ali made him compensate the man (by letting the punished man lash him back).

(١٧٥٥١) عبداللہ بن مغفل کہتے ہیں کہ حضرت علی نے ایک شخص کو حد لگوائی۔ جلاد نے ٢ کوڑے زیادہ مار دیے تو آپ نے اسے قصاص دلوایا۔
(17551) Abdullah bin Mughaffal kehte hain ki Hazrat Ali ne ek shakhs ko had laguai. Jallad ne 2 kore ziada maar diye to aap ne usay qisas dilvaya.
