Chapter on two men racing with their horses, each exits with an equal start, and each enters equal, on the condition that if the equal entered (racer) precedes, he takes what the two of them exited with, and if one of them enters before the equal enters,
باب الرجلين يستبقان بفرسيهما، ويخرج كل واحد منهما سبقا، ويدخلان بينهما محللا على أنه إن سبقهما المحلل، كان ما أخرجاه له، وإن سبق أحدهما المحلل أحرز ماله، وأخذ مال صاحبه
Sunan al-Kubra Bayhaqi 19770
Abu Huraira (may Allah be pleased with him) reported that the Prophet (peace and blessings of Allah be upon him) said: “Whoever enters a horse between two (horses) with full confidence that his horse will not be defeated, then it is gambling. And whoever enters a horse between two (horses) and he is not certain that his horse will not be defeated, then it is not gambling.”

(١٩٧٧٠) ابوہریرہ (رض) فرماتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جو شخص دو گھوڑوں کے درمیان ایسا گھوڑا داخل کر دے جس کے ہارنے کے متعلق مکمل بےخوف ہو تو یہ جوا ہے اور جس نے دو گھوڑوں کے درمیان ایسا گھوڑا داخل کردیا جس کے ہارنے کے متعلق وہ بےخوف نہیں ہے تو یہ جوا نہیں ہے۔
(19770) Abu Hurairah (Raz) farmate hain ki aap ((صلى الله عليه وآله وسلم)) ne farmaya: Jo shakhs do ghoron ke darmiyaan aisa ghora dakhil kar de jis ke harne ke mutalliq mukmmal bekhauf ho to yeh juwa hai aur jis ne do ghoron ke darmiyaan aisa ghora dakhil kar diya jis ke harne ke mutalliq wo bekhauf nahi hai to yeh juwa nahi hai.
Abu Hurairah (may Allah be pleased with him) narrated that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever enters a horse between two horses, being sure of its victory, then this is gambling. And whoever enters a third horse between two horses, while fearing its defeat, then this is not gambling."

(١٩٧٧١) ابوہریرہ (رض) فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا : جس نے دو گھوڑوں کے درمیان ایسا گھوڑا داخل کردیا جس کے جیتنے کا اس کو یقین ہے تو یہ جوا ہے اور جس نے دو گھوڑوں کے درمیان تیسرا گھوڑا بھی شامل کردیا اور اس کی ہار کا بھی خوف ہے تو یہ جوا نہیں۔
(19771) Abu Hurairah (RA) farmate hain keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne farmaya: Jis ne do ghoron ke darmiyan aisa ghora dakhil kardiya jis ke jeetne ka us ko yaqeen hai to yeh juwa hai aur jis ne do ghoron ke darmiyan teesra ghora bhi shamil kardiya aur us ki haar ka bhi khauf hai to yeh juwa nahin.
Said ibn Musayyab (may Allah have mercy on him) said that there is no harm in betting on horse racing when a third horse is also included. If it wins, he will receive the bet. If it loses, then there is nothing on it.

(١٩٧٧٢) سعید بن مسیب (رح) فرماتے ہیں کہ گھوڑ دوڑ میں شرط لگانے میں کوئی حرج نہیں، جب کوئی تیسرے گھوڑے کو بھی شامل کرلیں۔ اگر وہ جیت گیا تو شرط وصول کرلے گا۔ اگر ہار گیا تو پھر اس پر کچھ بھی نہیں ہے۔
Saeed bin Musayyab (rah) farmate hain ke ghor daud mein shart lagane mein koi harj nahin, jab koi teesre ghore ko bhi shamil kar len. Agar wo jeet gaya to shart wasool kar le ga. Agar haar gaya to phir us par kuchh bhi nahin hai.
Ibn Abi al-Zinad narrates from his father, who narrates from the jurists, that they said: It is permissible to bet on a horse race when a third horse is entered. If it wins, he takes the bet. If it loses, then he does not owe anything. And this third horse is like the one who sets free (a captive).

(١٩٧٧٣) ابن ابی الزناد اپنیوالد سے جو فقہاء سے بیان کرتے ہیں کہ وہ کہتے ہیں : گھوڑدوڑ میں شرط لگانا جائز ہے، جب کوئی تیسرا گھوڑا شامل کیا جائے۔ اگر وہ جیت جائے تو شرط کی رقم وصول کرے گا۔ اگر ہار گیا تو اس پر چٹی نہ ڈالی جائے گی اور یہ تیسرا گھوڑا ایسے گھوڑے کے مشابہ ہے جو رہائی دلانے والا ہے۔
(19773) Ibne Abi al-Zanaad apne wald se jo fuqha se bayan karte hain ki woh kehte hain : ghor daud mein shart lagana jaiz hai, jab koi teesra ghora shamil kya jaye. Agar woh jeet jaye to shart ki raqam wasool karega. Agar haar gaya to us par chitti na dali jayegi aur yeh teesra ghora aise ghore ke mushaba hai jo rihai dilane wala hai.
