باب: الوضع بشرط التعجيل، وما جاء في قطاعة المكاتب
Sunan al-Kubra Bayhaqi 21711
Nafi' narrates from Ibn 'Umar (may Allah be pleased with him) that he disliked it when someone, having entered into a contract of manumission with his slave in exchange for gold or silver in installments, would say, "Quickly pay me such and such amount so that the rest of you becomes yours."

(٢١٧١١) نافع ابن عمر (رض) سے نقل فرماتے ہیں کہ وہ فرماتے ہیں کہ جو انسان اپنے غلام سے سونے اور چاندی کے عوض قسطوں کے حساب سے مکاتبت کرتا ہے، وہ ناپسند کرتے کہ وہ کہے، جلدی مجھے اتنا دے دو جو باقی بچے وہ تیرا ہے۔
Nafi ibn Umar (RA) se naql farmate hain ki woh farmate hain ki jo insan apne gulam se sone aur chandi ke awaz qiston ke hisab se mukatabat karta hai, woh napasand karte ki woh kahe, jaldi mujhe itna de do jo baqi bache woh tera hai.
It is narrated from Hasan and Muhammad bin Sirin that both of them disliked it when it was said about debts: "Pay the amount quickly, and I will reduce the price."

(٢١٢١٧) حضرت حسن اور محمد بن سیرین سے منقول ہے کہ وہ دونوں مکاتب کے بارے ناپسند فرماتے کہ کہا جائے : جلدی رقم ادا کر دو ، میں قیمت میں کمی کر دوں گا۔
21217 Hazrat Hasan aur Muhammad bin Sireen se manqol hai ki woh donon makatib ke bare napasand farmate ke kaha jaye: jaldi raqam ada kar do, main qeemat mein kami kar doonga.
(21713) Ibn Abbas (may Allah be pleased with him) narrated that it was said to the writer of a contract of debt: “Write that (the debtor) should pay quickly and I will reduce some (of the debt). There is no harm in it.”
Shaykh Abu Walid said: “Write that you pay quickly what you owe and I will set you free (from being a slave). There is no harm in writing it and terminating the contract of debt.”

(٢١٧١٣) ابن عباس (رض) فرماتے ہیں کہ مکاتب سے کہا : جائے جلدی ادا کرو میں کمی کروں گا اس میں کوئی حرج نہیں۔
شیخ ابو ولید فرماتے ہیں : جلدی ادا کرو جو چاہو، میں اس پر تجھے آزاد کروں گا اور کتابت کو ختم کر دوں گا کہنے میں کوئی حرج نہیں ہے۔
(21713) Ibn Abbas (RA) farmate hain keh katib se kaha jaye jaldi ada karo mein kami karunga is mein koi harj nahin. Sheikh Abu Walid farmate hain jaldi ada karo jo chaho mein is par tujhe azad karunga aur kitaabat ko khatam kar dunga kehne mein koi harj nahin hai.
Qasim bin Muhammad said: 'Umar bin Al-Khattab disliked that any profit should be sought from the price of a slave's manumission document when it was paid for in gold or silver. He said, 'Rather, stipulate whatever goods you wish for a third, a quarter, or whatever is possible.' Qasim said that 'Umar bin 'Abdul-'Aziz wrote this letter to Abu Bakr bin Muhammad.

(٢١٧١٤) قاسم بن محمد فرماتے ہیں کہ حضرت عمر بن خطاب (رض) ناپسند کرتے کہ مکاتبت کی قیمت میں سے جو سونا اور چاندی ہے اس میں کمائی جائے، پھر اس میں ثلث، ربعیاجو ہو سکے سامان میں جو چاہو مقرر کرلو۔ قاسم کہتے ہیں کہ حضرت عمر بن عبدالعزیز نے یہ خط ابوبکر بن محمد کی طرف لکھا۔
