Chapter: Prayer Over Those Executed by the Legal Punishment
باب الصلاة على من قتلته الحدود
Sunan al-Kubra Bayhaqi 6829
Imran ibn Husain reported that a woman from Juhayna came to the Messenger of Allah (ﷺ) and she was pregnant as a result of fornication. He (ﷺ) commanded her guardians to treat her well and said: "When she gives birth, bring her to me." So they did that. He (ﷺ) commanded, and her clothes were tied around her. Then, she was commanded to be stoned, and she was stoned. Then, he (ﷺ) offered her funeral prayer. Umar (رض) said: "O Messenger of Allah! Will you offer her funeral prayer, while she committed fornication?" He (ﷺ) replied: "She has repented with such a repentance that if it were to be divided among the people of Madinah, it would suffice them. Have you found anything better than this, meaning that she sacrificed her life in repentance?".

(٦٨٢٩) عمران بن حصین بیان کرتے ہیں کہ قبیلہ جہینہ کی ایک عورت رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس آئی اور وہ زنا سے حاملہ تھی تو آپ (صلی اللہ علیہ وآلہ وسلم) نے ان کے سر پر پرستوں کو اس سے حسن سلوک کا حکم دیا اور فرمایا : جب وہ وضع حمل کرلے تو اسے میرے پاس لاؤ تو انھوں نے ایسا ہی کیا۔ آپ (صلی اللہ علیہ وآلہ وسلم) نے حکم دیا اور اس کے کپڑوں کو اس پر باندھ دیا گیا ۔ پھر اسے رجم کرنے کا حکم دیا گیا اور وہ رجم کردی گئی۔ پھر آپ (صلی اللہ علیہ وآلہ وسلم) نے اس کا جنازہ پڑھا تو عمر (رض) نے کہا : اے اللہ کے رسول ! کیا آپ اس کا جنازہ پڑھیں گے ، اس نے زنا کیا ہے ! تو آپ (صلی اللہ علیہ وآلہ وسلم) نے فرمایا کہ اس نے ایسی توبہ کی ہے کہ اگر اسے اہل مدینہ پر تقسیم کردیا جائے تو وہ ان پر وافر ہوجائے ۔ کیا تو نے کوئی چیز اس سے بہتر پائی ہے ، یعنی توبہ میں اس نے اپنی جان قربان کردی ہے۔
(6829) Imran bin Husain bayan karte hain keh qabeela Jaheena ki aik aurat Rasool Allah ((صلى الله عليه وآله وسلم)) ke pass aayi aur wo zina se hamil thi to aap ((صلى الله عليه وآله وسلم)) ne un ke sar par paraston ko us se husn sulook ka hukum diya aur farmaya : Jab wo waza e hamal kar le to use mere pass lao to unhon ne aisa hi kiya. Aap ((صلى الله عليه وآله وسلم)) ne hukum diya aur us ke kapdon ko us par bandh diya gaya . Phir use rajm karne ka hukum diya gaya aur wo rajm kardi gayi. Phir aap ((صلى الله عليه وآله وسلم)) ne us ka janaza parha to Umar (RA) ne kaha : Ae Allah ke Rasool! kya aap us ka janaza parhain ge , us ne zina kiya hai! to aap ((صلى الله عليه وآله وسلم)) ne farmaya keh us ne aisi tauba ki hai keh agar use ahl Madinah par taqseem kar diya jaye to wo un par waafir ho jaye. Kya tu ne koi cheez us se behtar payi hai, yani tauba mein us ne apni jaan qurban kardi hai.
Abdullah bin Buraidah reported from his father in the narration of that Ghamidi woman who was stoned to death for committing adultery, that the Prophet (peace and blessings of Allah be upon him) said: "By Him in Whose Hand is my life, this woman has repented such a repentance that if it were to be divided among those who take illegal taxes, it would suffice them." Then you (peace and blessings of Allah be upon him) commanded that her funeral prayer should be offered and she was buried.

(٦٨٣٠) عبداللہ بن بریدہ اپنے باپ سے بیان کرتے ہیں۔ اس غامدیہ کے قصے میں جسے زنا کی حد میں رجم کیا گیا کہ نبی کریم (صلی اللہ علیہ وآلہ وسلم) نے ارشاد فرمایا : مجھے قسم ہے اس ذات کی جس کے ہاتھ میں میری جان ہے اس عورت نے ایسی توبہ کی ہے کہ اگر اس توبہ کونا جائز ٹیکس لینے والوں پر تقسیم کیا جاتا تو انھیں بھی معاف کردیا جاتا۔ پھر آپ (صلی اللہ علیہ وآلہ وسلم) نے حکم دیا اس کا جنازہ پڑھا گیا اور دفن کردیا گیا۔
(6830) Abdullah bin Buraidah apne baap se bayan karte hain is ghamidiyah ke qisse mein jise zina ki had mein rajm kiya gaya ke Nabi Kareem ((صلى الله عليه وآله وسلم)) ne irshad farmaya mujhe qasam hai is zaat ki jis ke hath mein meri jaan hai is aurat ne aisi tauba ki hai ke agar is tauba ko un jaiz tax lene walon par taqseem kiya jata to unhen bhi maaf kar diya jata phir aap ((صلى الله عليه وآله وسلم)) ne hukm diya iska janaza parha gaya aur dafan kar diya gaya
Abu Burdah reported that the Prophet (ﷺ) did not offer the funeral prayer of Ma'iz b. Malik and did not forbid it, and it was narrated to us from 'Ali b. Abu Talib that when he had stoned to death Shuraha al-Hamdaniya, he said: Deal with her (her dead body) in the same way as you deal with your dead.

(٦٨٣١) ابو بردہ بیان کرتے ہیں کہ آپ (صلی اللہ علیہ وآلہ وسلم) نے ماعز بن مالک کی نماز جنازہ ادا نہ کی اور نہ ہی ادا کرنے سے منع کیا اور ہمیں علی بن طالب سے یہ بیان کیا گیا کہ جب انھوں نے شراحہ ہمدانیہ کو رجم کیا تو کہا : تم اس کے ساتھ وہی کچھ کرو جو اپنے فوت ہونے والوں کے ساتھ کرتے ہو۔
(6831) Abu Burda bayan karte hain ke aap ((صلى الله عليه وآله وسلم)) ne Maaz bin Malik ki namaz janaza ada na ki aur na hi ada karne se mana kiya aur humain Ali bin Talib se ye bayan kiya gaya ke jab unhon ne Sharaha Hamdaniya ko rajm kiya to kaha: Tum iske sath wohi kuch karo jo apne foot hone walon ke sath karte ho.
