Sunan al-Kubra Bayhaqi 11731
(11731) Ibn Shihab asked Sa'id ibn al-Musayyib about renting land for gold and silver, and he said: There is no harm in it. (4) Chapter: Regarding the one who permitted sharecropping for a known share, and considered the prohibition against it to be for discouraging something disliked (tanzih), or if the contract contains a void condition.

(١١٧٣١) ابن شہاب نے سعید بن مسیب سے زمین کرایہ پر لینے کے بارے میں سوال کیا سونے اور چاندی کے بدلے تو انھوں نے کہا : اس میں کوئی حرج نہیں ہے۔ (٤) باب مَنْ أَبَاحَ الْمُزَارَعَۃَ بِجُزْئٍ مَعْلُومٍ مَشَاعٍ وَحَمَلَ النَّہْیَ عَنْہَا عَلَی التَّنْزِیہِ أَوْ عَلَی مَا لَوْ تَضَمَّنَ الْعَقْدُ شَرْطًا فَاسِدًا جس نے مزارعت کو مشترک معلوم حصے کے عوض مباح کیا اور نہی کو تنزیہی پر محمول کیا یا یہ کہ معاملہ میں شرط فاسد ہو

١١٧٣١ - أَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، وَأَبُو بَكْرِ بْنُ الْحَسَنِ،قَالَا:ثنا أَبُو الْعَبَّاسِ، أنبأ الرَّبِيعُ، أنبأ الشَّافِعِيُّ، أنبأ مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّهُ سُئِلَ عَنِ اسْتِكْرَاءِ الْأَرْضِ بِالذَّهَبِ وَالْوَرِقِ،فَقَالَ:" لَا بَأْسَ بِهِ "قَالَ: وَأَنْبَأَ مَالِكٌ عَنْ هِشَامٍ عَنْ أَبِيهِ شَبِيهًا بِهِ،قَالَ:وَأَنْبَأَ مَالِكٌ عَنِ ابْنِ شِهَابِ عَنْ سَالِمٍ مِثْلَهُ
