Sunan al-Kubra Bayhaqi 12331
Ash'ath bin Abi al-Sha'tha said: I heard Aswad bin Yazid saying: Muadh (RA) gave a verdict among us in Yemen regarding a man who left behind a daughter and a sister, that the daughter gets half and the sister is also given half. Imam Abu Dawud (RA) said: Aswad bin Yazid gave verdicts among us in Yemen. A man who left behind a daughter and a sister was brought to the Prophet (ﷺ). You (ﷺ) gave half to the daughter and half to the sister.

(١٢٣٣١) اشعث بن ابی الشعثاء فرماتے ہیں : میں نے اسود بن یزید سے سنا وہ کہتے تھے کہ معاذ (رض) نے یمن میں ہمارے درمیان ایسے آدمی کا فیصلہ کیا جس نے بیٹی اور بہن چھوڑی تھی کہ بیٹی کے لیے نصف ہے اور بہن کو بھی نصف دیا۔ امام ابوداؤد (رح) فرماتے ہیں : اسود بن یزید نے یمن میں ہمارے درمیان فیصلہ کیا، رسول اللہ (صلی اللہ علیہ وآلہ وسلم) کے پاس ایک آدمی کو لایا گیا جس نے بیٹی اور بہن چھوڑی تھی، آپ (صلی اللہ علیہ وآلہ وسلم) نے بیٹی کو نصف دیا اور بہن کو بھی نصف دیا۔
Ashas bin Abi al-Sha'tha farmate hain : maine Aswad bin Yazid se suna woh kahte the ke Muaz (rz) ne Yemen mein humare darmiyan aise aadmi ka faisla kiya jisne beti aur bahan chhodi thi ke beti ke liye nisf hai aur bahan ko bhi nisf diya. Imam Abu Dawud (rh) farmate hain : Aswad bin Yazid ne Yemen mein humare darmiyan faisla kiya, Rasul Allah ((صلى الله عليه وآله وسلم)) ke paas ek aadmi ko laya gaya jisne beti aur bahan chhodi thi, aap ((صلى الله عليه وآله وسلم)) ne beti ko nisf diya aur bahan ko bhi nisf diya.
١٢٣٣١ -قَالَ:أَبُو دَاوُدَ: قَالَ شُعْبَةُ: وَأَخْبَرَنِي الْأَعْمَشُ قَالَ: سَمِعْتُ إِبْرَاهِيمَ يُحَدِّثُ عَنِ الْأَسْوَدِ بْنِ يَزِيدَ قَالَ:" قَضَى فِينَا مُعَاذٌ بِالْيَمَنِ أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ جِيءَ فِي رَجُلٍ تَرَكَ ابْنَتَهُ وَأُخْتَهُ، فَأَعْطَى الِابْنَةَ النِّصْفَ، وَالْأُخْتَ النِّصْفَ "كَذَا رَوَاهُ أَبُو دَاوُدَ الطَّيَالِسِيُّ، وَرِوَايَةُ غُنْدَرٍ أَصَحُّ وَقَدْ أَخْرَجَهُ الْبُخَارِيُّ مِنْ حَدِيثِ شَيْبَانَ عَنْ أَشْعَثَ مَوْقُوفًا
