Sunan al-Kubra Bayhaqi 12494
(12494) It is narrated on the authority of Qatadah (may Allah be pleased with him) that Hadrat Ali (may Allah be pleased with him) and Ibn Masud (may Allah be pleased with him) said regarding the son of the cursed one (i.e., the one who falsely accuses his father of adultery): "He who abandons (i.e., disinherits) his brother and mother, then for the brother is one-third and for the mother is also one-third." Zaid (may Allah be pleased with him) said: "For the mother is one-third, for the brother is one-sixth, and the remainder is for Baitul Maal (the public treasury)."

(١٢٤٩٤) حضرت قتادہ (رض) سے روایت ہے کہ حضرت علی (رض) اور ابن مسعود (رض) نے ملاعنہ کے بیٹے کے بارے میں کہا : جس نے بھائی اور ماں کو چھوڑا تو بھائی کے لیے ثلث اور ماں کے لیے بھی ثلث ہے۔ زید (رض) نے کہا : ماں کے لیے ثلث، بھائی کے لیے سدس اور باقی بیت المال کے لیے ہے۔
Hazrat Qatada (RA) se riwayat hai ki Hazrat Ali (RA) aur Ibn Masood (RA) ne mulaane ke bete ke bare mein kaha: Jisne bhai aur maan ko chhoda to bhai ke liye suls aur maan ke liye bhi suls hai. Zaid (RA) ne kaha: Maan ke liye suls, bhai ke liye suds aur baqi baitulmaal ke liye hai.
١٢٤٩٤ - أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ، ثنا يَحْيَى، أنا يَزِيدُ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ،أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ رَضِيَ اللهُ عَنْهُمَا قَالَا فِي ابْنِ الْمُلَاعَنَةِ تَرَكَ أَخَاهُ وَأُمَّهُ:" لِلْأَخِ الثُّلُثُ، وَلِلْأُمِّ الثُّلُثُ "،وَقَالَ زَيْدٌ:" لِلْأَخِ السُّدُسُ، وَلِلْأُمِّ الثُّلُثُ، وَمَا بَقِيَ فَلِبَيْتِ الْمَالِ "
