Chapter on seeking permission from slaves and children regarding the three 'awrahs, and seeking permission from those who have reached puberty in all situations
باب استئذان المملوك والطفل في العورات الثلاث، واستئذان من بلغ الحلم منهم في جميع الحالات

Ata said: I said to Ibn Abbas (may Allah be pleased with him): I have two sisters in my guardianship and I spend on them, so should I also seek their permission (i.e. when entering the house)? He replied in the affirmative. I said to him: This is a cause of hardship for me. He said: Allah Almighty says: {O you who believe! Let your [slaves] who are your possession, and those of you who have not yet attained puberty, ask your permission [before entering your private quarters]…} [An-Nur 59]. Ibn Abbas (may Allah be pleased with him) said: It is obligatory to seek permission at these three times. Then he recited this verse: {And when the children among you attain puberty…} [An-Nur 59].

(١٣٥٥٤) حضرت عطاء فرماتے ہیں کہ میں نے ابن عباس (رض) سے کہا : میری پرورش میں میری دو بہنیں ہیں اور میں ان پر خرچ کرتا ہوں تو کیا میں بھی ان سے اجازت لوں ؟ (یعنی گھر داخل ہوتے وقت) انھوں نے ہاں میں جواب دیا، میں نے ان سے کہا : یہ تو میرے لیے مشقت کا باعث ہے، انھوں نے کہا : اللہ تعالیٰ کا فرمان ہے : { یٰٓاَیُّہَا الَّذِیْنَ اٰمَنُوْا لِیَسْتَاْذِنْکُمْ۔۔۔} [النور ٥٩] ابن عباس (رض) نے کہا کہ ان تینوں اوقات میں اجازت طلب کرنے کا حکم ہے۔ پھر یہ آیت پڑھی : { وَاِذَا بَلَغَ الْاَطْفَالُ۔۔۔ } [النور ٥٩]
(13554) Hazrat Ata farmate hain ki maine Ibn Abbas (RA) se kaha : meri parvarish mein meri do behen hain aur mein un par kharch karta hun to kya mein bhi un se ijazat lun? (yani ghar dakhil hote waqt) unhon ne haan mein jawab diya, maine un se kaha : yeh to mere liye mushqat ka baais hai, unhon ne kaha : Allah Ta'ala ka farmaan hai : {Ya ayyuhal lazeena amano liyasta'zinukkum...} [Al-Noor 59] Ibn Abbas (RA) ne kaha ki un teenon auqat mein ijazat talab karne ka hukm hai. Phir yeh ayat parha : {Wa iza balagha al-atfal...} [Al-Noor 59].
١٣٥٥٤ - أَخْبَرَنَا أَبُو نَصْرِ بْنُ قَتَادَةَ، أنبأ أَبُو مَنْصُورٍ النَّضْرَوِيّ، ثنا أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ،عَنْ عَطَاءٍ قَالَ:قُلْتُ لِابْنِ عَبَّاسٍ:" فِي حِجْرِي أُخْتَانِ أُمَوِّنُهُمَا، وَأُنْفِقُ عَلَيْهِمَا، فَأَسْتَأْذِنُ عَلَيْهِمَا؟قَالَ:"نَعَمْ"،فَرَادَدْتُهُ قُلْتُ:إِنَّ ذَا يَشُقُّ عَلَيَّ قَالَ: إِنَّ اللهَ تَعَالَى يَقُولُ:{يَا أَيُّهَا الَّذِينَ آمَنُوا لِيَسْتَأْذِنْكُمُ الَّذِينَ مَلَكَتْ أَيْمَانُكُمْ، وَالَّذِينَ لَمْ يَبْلُغُوا الْحُلُمَ مِنْكُمْ ثَلَاثَ مَرَّاتٍ مِنْ قَبْلِ صَلَاةِ الْفَجْرِ، وَحِينَ تَضَعُونَ ثِيَابَكُمْ مِنَ الظَّهِيرَةِ، وَمِنْ بَعْدِ صَلَاةِ الْعِشَاءِ ثَلَاثُ عَوْرَاتٍ لَكُمْ}[النور: ٥٨]إِلَى آخِرِ الْآيَةِ قَالَ ابْنُ عَبَّاسٍ: "فَلَمْ يَأْمُرْ هَؤُلَاءِ بِالْإِذْنِ إِلَّا فِي الْعَوْرَاتِ الثَّلَاثِ قَالَ:{وَإِذَا بَلَغَ الْأَطْفَالُ مِنْكُمُ الْحُلُمَ فَلْيَسْتَأْذِنُوا كَمَا اسْتَأْذَنَ الَّذِينَ مِنْ قَبْلِهِمْ}[النور: ٥٩]"
