Chapter on a man being alone with his wife and then divorcing her before touching her
باب الرجل يخلو بامرأته ثم يطلقها قبل المسيس
Sunan al-Kubra Bayhaqi 14477
(14477) Shu'bi narrated that 'Amr bin Nafi' divorced his wife. The woman thought that he had consummated the marriage with her, while the husband denied it. The dispute came to the court of Judge Shuraih, so Judge Shuraih made 'Amr swear an oath that he had not consummated the marriage and ordered him to pay half of the dowry. (b) Mughirah narrated from Shu'bi from Shuraih that a man, after marriage, closed the door and hung the curtains, then divorced his wife before consummation. Judge Shuraih gave the verdict that he must pay half of the dowry.

(١٤٤٧٧) شعبی فرماتے ہیں کہ عمرو بن نافع نے اپنی بیوی کو طلاق دے دی تو عورت کا گمان تھا کہ وہ اس کے قریب آیا ہے جبکہ خاوند نے انکار کردیا۔ جھگڑا قاضی شریح کی عدالت میں آیا تو قاضی شریح نے عمرو سے قسم لی کہ وہ اس کے قریب نہیں گیا اور نصف حق مہر بھی ادا کرے۔ (ب) مغیرہ عن شعبی عن شریح ہے کہ ایک شخص نے شادی کے بعد دروازہ بند کرلیا اور پردے لٹکا دیے، پھر مجامعت سے پہلے طلاق دے دی تو قاضی شریح نے نصف حق مہر ادا کرنے کا فیصلہ سنایا۔
14477 Shobai farmate hain ke Amr bin Nafe ne apni biwi ko talaq de di to aurat ka gumaan tha ke wo uske qareeb aaya hai jabke khawand ne inkar kardiya. Jhagra qazi Shuraih ki adalat mein aaya to qazi Shuraih ne Amr se qasam li ke wo uske qareeb nahi gaya aur nisf haq mehr bhi ada kare. b Mughira an Shobai an Shuraih hai ke ek shakhs ne shadi ke baad darwaza band karliya aur parde latka diye, phir mujamma se pehle talaq de di to qazi Shuraih ne nisf haq mehr ada karne ka faisla sunaya.
١٤٤٧٧ - أَخْبَرَنَا عُمَرُ بْنُ أَحْمَدَ الْعَبْدَوِيُّ، أنبأ أَبُو الْفَضْلِ بْنُ خُمَيْرَوَيْهِ، أنبأ أَحْمَدُ بْنُ نَجْدَةَ، ثنا سَعِيدُ بْنُ مَنْصُورٍ، ثنا هُشَيْمٌ، أنبأ إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، أَنَّ عَمْرَو بْنَ نَافِعٍ طَلَّقَ امْرَأَتَهُ وَكَانَتْ قَدْ أُدْخِلَتْ عَلَيْهِ فَزَعَمَ أَنَّهُ لَمْ يَقْرَبْهَا وَزَعَمَتْ أَنَّهُ قَدْ قَرُبَهَا ⦗٤١٦⦘ فَخَاصَمَتْهُ إِلَى شُرَيْحٍ" فَصَبَرَ شُرَيْحٌ يَمِينَ عَمْرٍو بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ مَا قَرُبِهَا وَقَضَى عَلَيْهِ بِنِصْفِ الصَّدَاقِ "وَرَوَاهُ الثَّوْرِيُّ عَنْ إِسْمَاعِيلَ وَمُغِيرَةَ عَنِ الشَّعْبِيِّ عَنْ شُرَيْحٍ" أَنَّ رَجُلًا تَزَوَّجَ امْرَأَةً فَأَغْلَقَ الْبَابَ وَأَرْخَى السِّتْرَ ثُمَّ طَلَّقَهَا وَلَمْ يَمَسَّهَا فَقَضَى لَهَا شُرَيْحٌ بِنِصْفِ الصَّدَاقِ "أَخْبَرَنَاهُ أَبُو بَكْرٍ الْأَرْدَسْتَانِيُّ، أنبأ أَبُو نَصْرٍ الْعِرَاقِيُّ، أنبأ سُفْيَانُ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ فَذَكَرَهُ
