Sunan al-Kubra Bayhaqi 15731

(15731) It is narrated on the authority of Umar bin Khattab (ra) that the statement of Fatima bint Qais (ra) reached him. He said: We cannot abandon the Book of Allah on account of the statement of a woman. Perhaps she has forgotten. And similarly, it has been narrated to him by Isbat bin Muhammad, from A'mash, with a break in the chain. And it has been narrated by Ash'ath from Hukm, from Hammad, from Ibrahim, from Aswad, from Umar (ra), that he said regarding this matter: This is the Sunnah of our Prophet. Ash'ath bin Sawwar is weak.

(١٥٧٣١) حضرت عمر بن خطاب (رض) سے روایت ہے کہ اس کو فاطمہ بنت قیس (رض) کا قول پہنچا۔ کہتے ہیں : ہم اللہ کی کتاب کو عورت کے قول کی وجہ سے نہیں چھوڑ سکتے۔ شایدوہ بھول گئی ہو۔ اور اسی طرح اس کو اسباط بن محمد نے اعمش سے موقوف روایت کیا ہے اور اس کو اشعث نے حکم اور حماد سے ابراہیم سے اسود سے عمر (رض) سے روایت کیا ہے ، انھوں نے اس بارے میں فرمایا : ہمارے نبی کی سنت ہے۔ اشعث بن سوار ضعیف ہے۔

Hazrat Umar bin Khattab (RA) se riwayat hai ki usko Fatima bint Qais (RA) ka qaul pohancha. Kehte hain : Hum Allah ki kitaab ko aurat ke qaul ki wajah se nahi chhor sakte. Shayad wo bhul gayi ho. Aur isi tarah usko Asbaat bin Muhammad ne Aamash se mauqoof riwayat kiya hai aur usko Ashas ne Hukm aur Hammad se Ibrahim se Aswad se Umar (RA) se riwayat kiya hai, unhon ne is baare mein farmaya : Humare Nabi ki sunnat hai. Ashas bin Sawar zaeef hai.

١٥٧٣١ - أَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ،وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا:أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ، نا إِبْرَاهِيمُ بْنُ حَمَّادٍ، نا الْحُسَيْنُ بْنُ عَلِيِّ بْنِ الْأَسْوَدِ، نا مُحَمَّدُ بْنُ فُضَيْلٍ، نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، عَنِ الْأَسْوَدِ،عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ أَنَّهُ لَمَّا بَلَغَهُ قَوْلُ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَ:" لَا نَدَعُ كِتَابَ اللهِ لِقَوْلِ امْرَأَةٍ لَعَلَّهَا نَسِيَتْ "وَكَذَلِكَ رَوَاهُ أَسْبَاطُ بْنُ مُحَمَّدٍ، عَنِ الْأَعْمَشِ مَوْقُوفًا،وَرَوَاهُ أَشْعَثُ عَنِ الْحَكَمِ وَحَمَّادٍ عَنْ إِبْرَاهِيمَ عَنِ الْأَسْوَدِ عَنْ عُمَرَ رَضِيَ اللهُ عَنْهُ قَالَ فِيهِ:" وَسُنَّةُ نَبِيِّنَا "وَأَشْعَثُ بْنُ سَوَّارٍ ضَعِيفٌ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنْ عُمَرَ رَضِيَ اللهُ عَنْهُ مَوْصُولًا مُسْنَدًا
