Sunan al-Kubra Bayhaqi 18697
Hakim bin Umair narrates that Umar bin Khattab (may Allah be pleased with him) wrote to the commanders of the armies that if any group of Mujahideen (warriors fighting for the cause of Islam) happens to be traveling and night falls while they are in the territory of a people with whom a treaty has been made, then they (the Mujahideen) should not be guests of those people. If they do so, then the treaty is void and the covenant is broken.

(١٨٦٩٧) حکیم بن عمیر فرماتے ہیں کہ حضرت عمر بن خطاب (رض) نے لشکروں کے امراء کو خط لکھا کہ مجاہدین کے کس گروہ کو معاھدین کے کسی علاقہ میں رات ہوجائے حالت سفر میں وہ ان کی ضیافت نہ کریں۔ تو ان سے معاہدہ ختم، ذمہ ختم۔
18697 Hakim bin Umair farmate hain ki Hazrat Umar bin Khattab (RA) ne lashkaron ke umara ko khat likha ki mujahideen ke kis giroh ko moahdeen ke kisi ilaqe mein raat hojae halat safar mein woh un ki ziyafat na karen. To un se moahida khatam, zimma khatam.
١٨٦٩٧ - أَخْبَرَنَا أَبُو طَاهِرٍ الْفَقِيهُ، ثنا أَبُو بَكْرٍ الْقَطَّانُ، ثنا إِبْرَاهِيمُ بْنُ الْحَارِثِ، ثنا يَحْيَى بْنُ أَبِي بُكَيْرٍ، ثنا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، حَدَّثَنِي الْأَحْوَصُ بْنُ حَكِيمٍ، وَأَبُو بَكْرِ بْنُ عَبْدِ اللهِ بْنِ أَبِي مَرْيَمَ، عَنْ حَكِيمِ بْنِ عُمَيْرٍ،قَالَ:كَتَبَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللهُ عَنْهُ إِلَى أُمَرَاءِ الْأَجْنَادِ، فَذَكَرَهُ،قَالَ:وَأَيُّمَا رُفْقَةٍ مِنَ الْمُهَاجِرِينَ آوَاهُمُ اللَّيْلُ إِلَى قَرْيَةٍ مِنْ قُرَى الْمُعَاهَدِينَ مِنْ مُسَافِرِينَ فَلَمْ يَأْتُوهُمْ بِالْقِرَى فَقَدْ بَرِئَتْ مِنْهُمُ الذِّمَّةُ
