Sunan al-Kubra Bayhaqi 21771
(21771) Said ibn Musayyab narrates that the Messenger of Allah (peace be upon him) ordered that the mothers of the children (Umm Walad) should be freed, they should not be included in the one-third inheritance, and they should not be sold to settle a debt. (b) Said ibn Musayyab narrates regarding the mothers of the children that the people said that the first order of Umar (may Allah be pleased with him) was regarding the freeing of the mothers of the children, but that is not the case. First and foremost, the Prophet (peace be upon him) freed them, did not include them in the one-third inheritance and did not sell them to settle a debt.

(٢١٧٧١) سعید بن مسیب فرماتے ہیں کہ رسول اللہ (صلی اللہ علیہ وآلہ وسلم) نے حکم دیا کہ امہات الاولاد کو آزاد کردیا جائے، ان کو ثلث میں نہ رکھا جائے اور قرض میں فروخت نہ کیا جائے۔ (ب) سعید بن مسیب امہات الاولاد کے بارے میں فرماتے ہیں کہ لوگوں نے کہا کہ حضرت عمر (رض) کا پہلا حکم امہات الاولاد کے بارے میں تھا کہ آزاد کی جائیں، لیکن ایسا نہ تھا۔ سب سے پہلے تو نبی (صلی اللہ علیہ وآلہ وسلم) نے ان کو آزاد کیا، ثلث میں ان کو نہ رکھا اور قرض میں فروخت بھی نہ کیا۔
21771 Saeed bin Musayyab farmate hain keh Rasul Allah ((صلى الله عليه وآله وسلم)) ne hukm diya keh Ummahaatul Aulad ko azad kar diya jaye, in ko suls mein na rakha jaye aur qarz mein farokht na kiya jaye. b Saeed bin Musayyab Ummahaatul Aulad ke bare mein farmate hain keh logon ne kaha keh Hazrat Umar (Razi Allah Anhu) ka pehla hukm Ummahaatul Aulad ke bare mein tha keh azad ki jayen, lekin aisa na tha. Sab se pehle to Nabi ((صلى الله عليه وآله وسلم)) ne in ko azad kiya, suls mein in ko na rakha aur qarz mein farokht bhi na kiya.
٢١٧٧١ - وَأَخْبَرَنَا أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، أنبأ أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنبأ مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ، أنبأ جَعْفَرُ بْنُ عَوْنٍ، أنبأ عَبْدُ الرَّحْمَنِ بْنُ زِيَادٍ، عَنْ مُسْلِمِ بْنِ يَسَارٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ،قَالَ:أَمَرَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بِعِتْقِ أُمَّهَاتِ الْأَوْلَادِ، وَلَا ⦗٥٧٧⦘ يُجْعَلْنَ فِي الثُّلُثِ، وَأَمَرَ أَنْ لَا يُبَعْنَ فِي الدَّيْنِ. .قَالَ جَعْفَرٌ:لَمْ يَرْوِ هَذَا الْحَدِيثَ غَيْرُهُ
