Sunan al-Kubra Bayhaqi 8213
(8312) It is narrated on the authority of Ata that he heard Abu Huraira (may Allah be pleased with him) saying about a sick person who falls ill and does not observe the fasts of Ramadan, then he recovers and does not make them up until the next Ramadan comes. He said: Then he should observe the fasts of this Ramadan that is present, and afterwards, he should make up for the other (missed fasts), and feed a poor person for every night (he missed the fast). It is narrated from Ibn Umar (may Allah be pleased with him) and Abu Huraira (may Allah be pleased with him) concerning the one who does not become well enough to fast until the next Ramadan, that he should feed (the poor) and there is no qada (making up) upon him. Hasan, Thawri, and Nakha'i say there is qada but no kaffarah (expiation), and we say: (He should fast) according to Allah's command: {Then (he should fast) the same number of days from other days}.

(٨٣١٢) عطاء فرماتے ہیں کہ انھوں نے ابوہریرہ (رض) سے سنا کہ انھوں نے مریض کے بارے میں کہا جو بیمار ہوتا ہے اور رمضان کا روزہ نہیں رکھتا ۔ پھر وہ تندرست ہوجاتا ہے اور روزے نہیں رکھتا حتیٰ کہ دوسرا رمضان آجاتا ہے۔ انھوں نے کہا : پھر وہ اس رمضان کے روزے رکھے گا جو موجود ہے بعد میں دوسرے کے رکھے گا اور ہر رات کے عوض مسکین کو کھانا کھلائے گا۔ ابن عمر (رض) اور ابوہریرہ (رض) سے اس کے بارے میں منقول ہے جو دوسرے رمضان تک صحیح نہیں ہوتا کہ وہ کھانا کھلائے اور اس پر قضا نہیں۔ حسن طاؤس اور نخعی فرماتے ہیں کہ قضا ہے لیکن کفارہ نہیں اور ہم کہتے ہیں اللہ کے فرمان کے تحت : { فَعِدَّۃٌ مِنْ أَیَّامٍ أُخَرَ }
(8312) Ataa farmate hain ki unhon ne Abu Huraira (RA) se suna ki unhon ne mareed ke bare mein kaha jo bimar hota hai aur Ramzan ka roza nahi rakhta. Phir wo tandarust hojata hai aur rozy nahi rakhta hatta ki doosra Ramzan ajata hai. Unhon ne kaha: Phir wo us Ramzan ke rozy rakhe ga jo mojood hai baad mein doosre ke rakhe ga aur har raat ke awaz miskeen ko khana khilaye ga. Ibn Umar (RA) aur Abu Huraira (RA) se is ke bare mein manqol hai jo doosre Ramzan tak sahih nahi hota ki wo khana khilaye aur us par qaza nahi. Hasan Taos aur Nakhai farmate hain ki qaza hai lekin kaffara nahi aur hum kehte hain Allah ke farmaan ke tahat: { Fa iddatan min ayyamin ukhar }.
٨٢١٣ - وَأَخْبَرَنَا أَبُو الْحُسَيْنِ بْنُ الْفَضْلِ الْقَطَّانُ بِبَغْدَادَ، أنبأ أَبُو سَهْلِ بْنُ زِيَادٍ الْقَطَّانُ، ثنا عَلِيُّ بْنُ مُحَمَّدِ بْنِ أَبِي الشَّوَارِبِ، ثنا سَهْلُ بْنُ بَكَّارٍ، ثنا أَبُو عَوَانَةَ، عَنْ رَقَبَةَ،قَالَ:زَعَمَ عَطَاءٌ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ، قَالَ فِي الْمَرِيضِ يَمْرَضُ وَلَا يَصُومُ رَمَضَانَ ثُمَّ يَبْرَأُ وَلَا يَصُومُ حَتَّى يُدْرِكَهُ رَمَضَانُ آخَرُ،قَالَ:" يَصُومُ الَّذِي حَضَرَهُ، وَيَصُومُ الْآخَرَ، وَيُطْعِمُ لِكُلِّ لَيْلَةٍ مِسْكِينًا "وَرَوَى هَذَا الْحَدِيثَ إِبْرَاهِيمُ بْنُ نَافِعٍ الْجَلَّابُ عَنْ عُمَرَ بْنِ مُوسَى بْنِ وَجِيهٍ عَنِ الْحَكَمِ عَنْ مُجَاهِدٍ عَنْ أَبِي هُرَيْرَةَ مَرْفُوعًا، وَلَيْسَ بِشَيْءٍ، إِبْرَاهِيمُ وَعُمَرُ مَتْرُوكَانِ،وَرُوِّينَا عَنِ ابْنِ عُمَرَ وَأَبِي هُرَيْرَةَ فِي الَّذِي لَمْ يَصِحَّ حَتَّى أَدْرَكَهُ رَمَضَانُ آخَرُ:يُطْعِمُ وَلَا قَضَاءَ عَلَيْهِ،وَعَنِ الْحَسَنِ وَطَاوُسٍ وَالنَّخَعِيِّ:يَقْضِي وَلَا كَفَّارَةَ عَلَيْهِ، وَبِهِ نَقُولُ،لِقَوْلِهِ تَعَالَى:{فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ}[البقرة: ١٨٤]
