باب إِذَا اقْتَسَمَ الشُّرَكَاءُ الدُّورَ أَوْ غَيْرَهَا فَلَيْسَ لَهُمْ رُجُوعٌ وَلاَ شُفْعَةٌ

Sahih al-Bukhari 2496
Jabir bin Abdullah (رضي الله تعالى عنه) narrated that the Prophet (صلى الله عليه وآله وسلم) said, ‘the right of preemption is valid in every joint property, but when the land is divided and the way is demarcated, then there is no right of pre-emption.’
حضرت جابر بن عبداللہ ؓ سے روایت ہے، انھوں نے کہا کہ نبی کریم ﷺ نے ہر اس چیز میں شفعے کا فیصلہ فرمایا ہے جو ابھی تقسیم نہ کی گئی ہو۔ جب حد بندی ہوجائے اور راستے بدل دیے جائیں تو شفعہ نہیں رہتا۔
Hazrat Jabir bin Abdullah (radiyallahu anhu) se riwayat hai, unhon ne kaha ke Nabi Kareem (sallallahu alaihi wasallam) ne har is cheez mein shufe ka faisla farmaya hai jo abhi taqseem na ki gayi ho. Jab had-bandi ho jaye aur raste badal diye jayein to shufa nahi rehta.
حَدَّثَنَا مُسَدَّدٌ ، حَدَّثَنَا عَبْدُ الْوَاحِدِ ، حَدَّثَنَا مَعْمَرٌ ، عَنِ الزُّهْرِيِّ ، عَنْ أَبِي سَلَمَةَ ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُمَا ، قَالَ : قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ مَا لَمْ يُقْسَمْ ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ .
