باب إِذَا أَعْتَقَ عَبْدًا بَيْنَ اثْنَيْنِ أَوْ أَمَةً بَيْنَ الشُّرَكَاءِ

Sahih al-Bukhari 2522
Narrated `Abdullah bin `Umar: Allah's Apostle said, Whoever frees his share of a common slave and he has sufficient money to free him completely, should let its price be estimated by a just man and give his partners the price of their shares and manumit the slave; otherwise (i.e. if he has not sufficient money) he manumits the slave partially.
حضرت عبداللہ بن عمر ؓ ہی سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا: ’’جو شخص مشترک غلام میں سے اپنا حصہ آزاد کردے، پھر اس کے پاس پورے غلام کی قیمت جتنا مال بھی ہوتو انصاف کے ساتھ اس کی قیمت لگائی جائے اور دوسرے شرکاء کا حصہ وہ ادا کرے، پھر وہ غلام اس کی طرف سے آزاد ہوجائے گا، بصورت دیگر غلام جتنا آزاد ہوچکا ہے اتنا ہی آزاد رہے گا۔‘‘
Hazrat Abdullah bin Umar (radiyallahu anhu) hi se riwayat hai ke Rasool Allah (sallallahu alaihi wasallam) ne farmaya: ''Jo shakhs mushtarik ghulam mein se apna hissa azad kar de, phir is ke paas pure ghulam ki qemat jitna maal bhi ho to insaf ke sath is ki qemat lagayi jaye aur dusre shuraka ka hissa wo ada kare, phir wo ghulam is ki taraf se azad ho jaye ga, basoorat-e-digar ghulam jitna azad ho chuka hai itna hi azad rahe ga.' '
حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، أَخْبَرَنَا مَالِكٌ ، عَنْ نَافِعٍ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ فَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ ، قُوِّمَ الْعَبْدُ عَلَيْهِ قِيمَةَ عَدْلٍ ، فَأَعْطَى شُرَكَاءَهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ ، وَإِلَّا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ .
