Chapter: Inheritance of loyalty.
باب: ميراث الولاء
Sunan al-Darimi 3169
It is narrated from Sha'bi (Sulayman bin Firoz): Sha'bi (RA) said: If a slave marries a woman and they have a son, if the woman is free, then the expenses (of the son) will be the responsibility of the mother (not the slave father). And if the son is also a slave, then his expenses will be upon his masters.

شیبانی (سلیمان بن فیروز) سے مروی ہے: شعبی رحمہ اللہ نے کہا: کوئی غلام کسی عورت سے شادی کرے اور اس سے لڑکا پیدا ہو جائے تو اگر عورت آزاد ہے تو نفقہ (خرچ) ماں کے ذمہ ہوگا (غلام باپ کے نہیں) اور اگر وہ لڑکا بھی غلام ہو تو اس کا خرچ اس کے آقاؤں پر ہو گا۔
Shibani (Sulaiman bin Firoz) se marvi hai: Shabi rehmatullah alaih ne kaha: Koi gulam kisi aurat se shadi kare aur us se ladka paida ho jaye to agar aurat azad hai to nafaqa (kharcha) maan ke zimma hoga (gulam baap ke nahi) aur agar wo ladka bhi gulam ho to us ka kharcha us ke aaqaon par ho ga.
(حديث مقطوع) حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا أَبُو شِهَابٍ، عَنْ الشَّيْبَانِيِّ، عَنْ الشَّعْبِيِّ: فِي الْعَبْدِ يَتَزَوَّجُ الْمَرْأَةَ، ثُمَّ يُطَلِّقُهَا وَلَهُ مِنْهَا وَلَدٌ؟ قَالَ: "إِنْ كَانَتْ حُرَّةً، فَالنَّفَقَةُ عَلَى أُمِّهِ، وَإِنْ كَانَ عَبْدًا، يَعْنِي: الصَّبِيَّ، فَعَلَى مُوَالِيهِ".
