‘Ali said:You recite this verse, “After a legacy you bequeathe or a debt (Al-Qur’an 4:12),’’ but God’s Messenger decided that a debt should be discharged before a legacy and that the sons of the same mother inherit from one another, but not the sons of one father by different mothers. A man inherits from his brother who has the same father and mother, but not from his brother who has the same father but a different mother. Tirmidhi and Ibn Majah transmitted it. In a version by Darimi he said, “Brothers who have the same mother inherit from one another but not sons of the same father but of different mothers, etc."

علی ؓ بیان کرتے ہیں ، تم یہ آیت تلاوت کرتے ہو :’’ وصیت پوری کرنے کے بعد جو تم وصیت کرتے ہو یا قرض کی ادائیگی کے بعد ۔‘‘ بے شک رسول اللہ ﷺ نے قرض کو وصیت سے پہلے ادا کرنے کا فیصلہ فرمایا ، اور سگے بھائی وارث ہوتے ہیں ، سوتیلے بھائی وارث نہیں ہوتے ، آدمی اپنے سگے بھائی کا وارث ہو گا سوتیلے بھائی کا وارث نہیں ہو گا ۔‘‘ ترمذی ، ابن ماجہ ۔ اور دارمی کی روایت میں ہے ، فرمایا :’’ سگے بھائی (ایک ہی ماں کی اولاد) وارث ہوں گے اور مختلف ماؤں کی اولاد (یعنی سوتیلے بھائی) وارث نہیں ہوں گے ۔‘‘ ضعیف ، رواہ الترمذی و ابن ماجہ و الدارمی ۔
Ali bayan karte hain, tum ye aayat tilawat karte ho: ''wasiyat puri karne ke baad jo tum wasiyat karte ho ya qarz ki adaegi ke baad.'' Be shak Rasool Allah ne qarz ko wasiyat se pehle ada karne ka faisla farmaya, aur sage bhai waris hote hain, sotele bhai waris nahin hote, aadmi apne sage bhai ka waris ho ga sotele bhai ka waris nahin ho ga.'' Tirmizi, Ibn Majah. Aur Darmi ki riwayat mein hai, farmaya: ''sage bhai (ek hi maan ki aulad) waris honge aur mukhtalif maon ki aulad (yani sotele bhai) waris nahin honge.'' Zaeef, Rawah al-Tirmizi wa Ibn Majah wa al-Darmi.
وَعَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ قَالَ: إِنَّكُمْ تقرؤون هَذِهِ الْآيَةَ: (مِنْ بَعْدِ وَصِيَّةٍ تُوصُونَ بِهَا أَو دين)\وَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالدّينِ قبل الْوَصِيَّةِ وَأَنَّ أَعْيَانَ بَنِي الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ الرَّجُلُ يَرِثُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ أَخِيهِ لِأَبِيهِ . رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ وَفِي رِوَايَةِ الدَّارِمِيِّ: قَالَ: «الْإِخْوَةُ مِنَ الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ. . .» إِلَى آخِره\
