Huzail b. Shurahbil said:Abu Musa was asked about a case where there were a daughter, a son’s daughter and a sister and replied, “The daughter gets half and the sister gets half. Go to Ibn Mas'ud and you will find that he agrees with me.” When Ibn Mas'ud was asked and told what Abu Musa had said he replied, “I would then be in error and not be one of those who are rightly guided. I decide concerning the matter as the Prophet did: The daughter gets half and the son’s daughter a sixth, making two-thirds, and what remains goes to the sister.” We then went to Abu Musa and when we told him what Ibn Mas'ud had said he replied, “Do not question me as long as this learned man is among you.” Bukhari transmitted it. (Here again we find a tradition by Bukhari in Section 2.)

ہُذیل بن شرحبیل بیان کرتے ہیں ، ابوموسیٰ اشعری ؓ سے بیٹی ، پوتی اور بہن کے حصے کے بارے میں سوال کیا گیا تو انہوں نے فرمایا : بیٹی کے لیے نصف ، بہن کے لیے نصف ، اور تم ابن مسعود ؓ کے پاس جاؤ وہ بھی میرے موافق فتویٰ دیں گے ، عبداللہ بن مسعود ؓ سے مسئلہ دریافت کیا گیا اور انہیں بتایا گیا کہ ابوموسی ؓ نے یہ فتوی دیا ہے ، تو انہوں نے فرمایا : تب تو میں گمراہ ہو گیا ، اور میں ہدایت یافتہ لوگوں میں سے نہیں ہوں ، میں اس کے متعلق وہی فیصلہ کروں گا جو نبی ﷺ نے کیا تھا ، بیٹی کے لیے نصف ، پوتی کے لیے چھٹا حصہ اسی طرح دو تہائی مکمل ہوا اور جو باقی بچے وہ بہن کے لیے ہے ، ہم ابوموسی ؓ کے پاس آئے تو انہیں ابن مسعود ؓ کے فتویٰ کے بارے میں بتایا تو انہوں نے فرمایا : جب تک یہ علاّمہ تم میں موجود ہے مجھ سے مسئلہ نہ پوچھا کرو ۔ رواہ البخاری ۔
Huzail bin Sharahbeel bayan karte hain, Abumusa Ashari se beti, poti aur behan ke hisse ke bare mein sawal kiya gaya to unhon ne farmaya: Beti ke liye nisf, behan ke liye nisf, aur tum Ibne Masood ke paas jao wo bhi mere muwafiq fatwa denge, Abdullah bin Masood se masla daryaft kiya gaya aur unhen bataya gaya ke Abumusa ne ye fatwa diya hai, to unhon ne farmaya: Tab to main gumrah ho gaya, aur main hidayat yafta logon mein se nahi hun, main iske mutalliq wohi faisla karunga jo Nabi ne kiya tha, beti ke liye nisf, poti ke liye chhata hissa isi tarah do tihai mukammal hua aur jo baqi bache wo behan ke liye hai, hum Abumusa ke paas aaye to unhen Ibne Masood ke fatwa ke bare mein bataya to unhon ne farmaya: Jab tak ye allama tum mein mojood hai mujhse masla na poocha karo. وَعَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ: سُئِلَ أَبُو مُوسَى عَنِ ابْنَةٍ وَبِنْتِ ابْنٍ وَأُخْتٍ فَقَالَ: للْبِنْت النّصْف وَللْأُخْت النّصْف وائت ابْنَ مَسْعُودٍ فَسَيُتَابِعُنِي فَسُئِلَ ابْنُ مَسْعُودٍ وَأُخْبِرَ بقول أبي مُوسَى فَقَالَ: لقد ضللت إِذن وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لِلْبِنْتِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ» فَأَتَيْنَا أَبَا مُوسَى فَأَخْبَرْنَاهُ بِقَوْلِ ابْنِ مَسْعُودٍ فَقَالَ: لَا تَسْأَلُونِي مَا دَامَ هَذَا الحبر فِيكُم. رَوَاهُ البُخَارِيّ
