Sahih Muslim 1245
Ata' said Ibn 'Abbas (رضي الله تعالى عنه) used to say that a pilgrim or non-pilgrim (one performing 'Umra) who circumambulates the House is free from the responsibility of Ihram. I (Ibn Juraij, one of the narrators) said to Ata, on what authority does he say this? He said, On the authority uf Allah's words – ‘then their place is (near) the old Honorable House for sacrifice’ (Al-Hajj - 33). I said, it concerns the time after staying at 'Arafat, whereupon he said, Ibn 'Abbas ( رضي الله تعالى عنه) had stated (that the place of sacrifice is the Ancient House); it may be after staying at 'Arafat or before (staying there). And Ibn Abbas ( رضئهللا تعالی عنہ) made this deduction from the command of Allah's Apostle (صلى الله عليه وآله وسلم) when he had ordered to put off Ihram on the occasion of the Farewell Pilgrimage.
عطاء رحمۃ اللہ علیہ بیان کرتے ہیں کہ حضرت ابن عباس رضی اللہ تعالیٰ عنہ فرماتے تھے، بیت اللہ کا طواف کرنے والا حاجی ہو یا حاجی نہ ہو (عمرہ کرنے والا ہو) وہ حلال ہو جائے گا، ابن جریج کہتے ہیں، میں نے عطاء سے سوال کیا، وہ کس دلیل کی بنا پر یہ کہتے ہیں؟ عطاء نے جواب دیا، اللہ کے اس فرمان کی رو سے ”قربانی کے پہنچنے کی جگہ بیت اللہ ہے۔“ (سورۃ حج، آیت نمبر: 33)
Ata (Rahmatullah Alaih) bayan karte hain ki Hazrat Ibn Abbas (Radiallahu Anhuma) farmate the, Baitullah ka tawaf karne wala Hajji ho ya Hajji na ho (Umrah karne wala ho) wo halal ho jayega, Ibn Juraij kehte hain, mein ne Ata se sawal kiya, wo kis daleel ki bina par ye kehte hain? Ata ne jawab diya, Allah ke is farman ki roo se "Qurbani ke pahunchne ki jagah Baitullah hai." (Surah Hajj, Ayat number: 33)
وَحَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، أَخْبَرَنَا مُحَمَّدُ بْنُ بَكْرٍ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي عَطَاءٌ، قَالَ كَانَ ابْنُ عَبَّاسٍ يَقُولُ لاَ يَطُوفُ بِالْبَيْتِ حَاجٌّ وَلاَ غَيْرُ حَاجٍّ إِلاَّ حَلَّ . قُلْتُ لِعَطَاءٍ مِنْ أَيْنَ يَقُولُ ذَلِكَ قَالَ مِنْ قَوْلِ اللَّهِ تَعَالَى { ثُمَّ مَحِلُّهَا إِلَى الْبَيْتِ الْعَتِيقِ} قَالَ قُلْتُ فَإِنَّ ذَلِكَ بَعْدَ الْمُعَرَّفِ . فَقَالَ كَانَ ابْنُ عَبَّاسٍ يَقُولُ هُوَ بَعْدَ الْمُعَرَّفِ وَقَبْلَهُ . وَكَانَ يَأْخُذُ ذَلِكَ مِنْ أَمْرِ النَّبِيِّ صلى الله عليه وسلم حِينَ أَمَرَهُمْ أَنْ يَحِلُّوا فِي حَجَّةِ الْوَدَاعِ .
