1
Chapter: The prohibition of divorcing a menstruating woman without her consent; If a man breaks this rule, it still counts as a divorce, and he should be ordered to take her back

باب تَحْرِيمِ طَلاَقِ الْحَائِضِ بِغَيْرِ رِضَاهَا وَأَنَّهُ لَوْ خَالَفَ وَقَعَ الطَّلاَقُ وَيُؤْمَرُ بِجْعَتِهَا
Sahih Muslim 1471g
A Hadith like this was reported on the authority of Zuhri with the same chain of narrators. Ibn Umar (رضئ هللا تعالی عنہ), however, said, I took her back, and counted this pronouncement of divorce (as valid) with which I divorced her.
یہی روایت امام صاحب ایک اور استاد کی سند سے زہری کی سند کے مطابق بیان کرتے ہیں۔ مگر اس میں یہ ہے ابن عمر رضی اللہ تعالیٰ عنہما نے کہا، میں نے بیوی سے رجوع کر لیا اور میں نے اس طلاق کو جو اسے دی تھی طلاق شمار کیا۔
Yehi riwayat Imam Sahab ek aur ustad ki sanad se Zuhri ki sanad ke mutabiq bayan karte hain. Magar is mein yeh hai Ibn Umar (Razi Allahu Anhuma) ne kaha, main ne biwi se rujoo' kar liya aur main ne us talaq ko jo use di thi talaq shumar kiya.
وَحَدَّثَنِيهِ إِسْحَاقُ بْنُ مَنْصُورٍ، أَخْبَرَنَا يَزِيدُ بْنُ عَبْدِ رَبِّهِ، حَدَّثَنَا مُحَمَّدُ بْنُ حَرْبٍ، حَدَّثَنِي الزُّبَيْدِيُّ، عَنِ الزُّهْرِيِّ، بِهَذَا الإِسْنَادِ غَيْرَ أَنَّهُ قَالَ قَالَ ابْنُ عُمَرَ فَرَاجَعْتُهَا وَحَسَبْتُ لَهَا التَّطْلِيقَةَ الَّتِي طَلَّقْتُهَا .
